With all due respect, you are mixing concepts. CR1 stands for “conditional resident”. A CR never gets a 10 year PR card. They only get a conditional one. They still have to file for ROC. The main difference between a CR1 and a K1 is that a CR one becomes a resident the minute they land in the US (albeit a conditional one). A K1 still has to do the whole AOS.  

 

Because what legal status would they have while they wait? 

 

This is irrelevant. What matters is how long have you been married when her PR card was approved. That Is the deciding factor to file (or not) for ROC. 

I stand corrected. If this is the case I would reschedule the interview in a heartbeat.

I appreciate the responses from everyone. It’s always nice to learn new things especially when the process is so frustrating and takes so long. So thank you for setting me straight.

With all due respect, but who cares about wait times when all she'll be doing is getting her conditional green card then in 2 years - back in a waiting game + back to dumping more money at USCIS? If she sucks it up and waits for a couple more months - she'll be saving time, money, and (should she choose to) becoming a US citizen in 3 years minus 90 days without worrying about her I-751 being approved on time (like what happened to me)?

Ultimately it’s a personal choice. I’d still go to the interview and ask for a delayed approval. If it works, fine, if not, you tried and then you file for ROC.

UPDATE: Our interview is on December 3rd, which is a Friday. Our 2 year anniversary is Tuesday, December 7th.

 

we are one business day off. we have decided not to risk rescheduling because Seattle field office is just too unpredictable. We’re hoping we get an officer who will be understanding and if not, it is what it is

Hey! We had a super by the book officer so we did end up getting the 2 year GC and not the 10 year. But it’s all good, we’re so happy to be in this next phase and knew the risk we were taking!
