I agree with the above. J1 visas for au pair programs have specific conditions and usually last for a year, with the possibility of a one year extension. So that's a max of two years, not three. Then there is also the difference between legal status and authorized stay. She might be confusing one with the other if she ever got a NOA allowing her to lawfully wait in the country for the result of a visa application.

 

In Immigration, all details and dates matter a lot, that's why you are getting the recommendation that your girlfriend joins this forum and completes a proper timeline (when and where J1 visa was issued, when it expired, when and how it was extended, when grace period began and ended, when application for tourist visa was sent and received, same for student visa, when biometrics were taken, etc). 

 

Based on that, you both are likely to get better predictions and recommendations for your case.

OP, let's be real.

Your girlfriend is trying everything to stay here and you are not sure to marry right know.

 

In your first post in October you asked about K1, now you said that don't want to marry right away. 

 

Sounds like you want to have a normal relationship when you have time to know the person better. This is great! Unfortunately doesn't exist a visa for this case.

 

I don't understand why is not her asking here about her status. Looks like she knows exactly what to do (she knows if she travel back to Brazil she will get a ban). Because you, like the majority of the people who never needed to learn about imigration process, she is telling you whatever she wants and you, because care about her, believe in everything. 

 

If you don't want to believe in anyone here is your choice. 

 

I will recommend you again to ask all this to a lawyer,  with her with you. So maybe you will really understand all the panorama of her case.

 

I don't think you have all the information and we will give answers based on that. If you want a different answer you will need to share specific and real details.

 

I really wish you can take your time to learn about all the imigration process so you can really understand what will be your future with her.

Your visa might be denied, if you have given wrong data in your visa application structure. On the off chance that you have a previous history of crimes against you. On the off chance that you apply for a visa without a substantial defense without prior warning.

And coming to apply for USA visa. So, these are steps one need to follow while applying,

  • Check on the off chance that you need a visa or not.
  • Pick the kind of US visa you will apply for.
  • Fill in the Non-immigrant visa Application Form DS-160.
  • Pay your application charge.
  • Schedule your visa meet 
  • Assemble the file document.
  • Go to the visa interview
  • Wait for processing.
