Hi all,

My Fiancé has been in Administrative Process since January, the Embassy requested his passport last week, and today he got it back but there was no visa. The status on CEAC changed with a new case created date also it went from immigrant to non-immigrant but it went back to REFUSED.
Has anyone experienced something similar. Why would the embassy ask for the passport and sent it back without a visa? 😞

Im confused why would it go from immigrant to non-immigrat. Did they switch it from K1 to something else. I didnt think that was possible. Maybe someone else can comment on that part.

I petitioned my husband for IR1, we got notice for processing completed in Jan2021 and asked to submit passport for visa. We got visa back without stamp, they said reason was for needing current medical. We gave them proof and they admitted it was current, but placed us in admin processing anyway and wont tell us why. I have asked many times as well as lawyer. Strange that ur case is doing something weird as well.

Technically the K1 is a non immigrant, but showed immigrant on the CEAC. Honestly we thought we were about to get the visa issued since they requested passport, out medical  is current etc.

No! Nothing , no further instructions from the Embassy. We weren’t denied the visa I’m assuming since they would of let us know along with the passport.

No, just the passport with no visa

That is weird. I wonder if there is something going on again against Middle Eastern countries. Ive heard of one other case with the Embassy asking for passport saying everything good and are gonna issue visa, then they get passport back without visa.
I filed a Writ of Mandamus due to this.

Sounds like the AP isn't finished, and they needed to check something in the passport.  Just my speculation.

But why would the Embassy say AP processing completed and then go back on that decision??

It is especially hard on ppl that have to travel to another country to send passport.
