That's right, I forgot about the petition fee.

However, today, I found out that you can get married on a ESTA then apply for marriage AOS. From our understanding, we would need to a find a place that hold legal weddings then fill/send in the appropriate forms for AOS. Is this correct? I've read that under Trump, they made changes to changing status while on ESTA. My finance has been here since December 29th so just over 50 days. His return flight is on March the 19th so our initial plan was for him to leave then. Roughly 80 days total. Will this be a problem?

 

I know there is fees for filling for AOS around $1250 but I also saw people mention a waiver. How does this work?

 

How long will it take for him to receive his temporary work permit, advanced parole and then his green card? Could we travel to another state while all this is pending? We would like to move in together in a new place

 

Currently, he works remotely for an online teaching platform that is a US company but it's an entry level position that didn't need any checks. Will he be able to continue working?

 

I understand this a lot of questions but i really appreciate if any could give some answers.

So he’s already in the US on ESTA and working here remotely for a US company? 
 

1. He’s not allowed to work with ESTA so is already in breach of his conditions of entry..

2. If he’s already here yes he can adjust

3. No he’s not allowed to work until authorised... EAD is taking ages, I submitted April 20 and still waiting..

He was asked by the immigration officer when he arrived in December how we would support himself during his stay. He told them about his job and they said nothing

Where did you get the wrong amount i.e. "1250"? Your case costs more than a regular K-1 AOS case since you also have to file I-130. I listed the fees on Page 1 of this thread and provided the official USCIS fee calculator.

Not sure what happened there, but he is not authorized to work while in the United States, in any capacity, without an EAD.

Then I’m really surprised they let him in... since he’s not permitted to work without Work Authority... I suggest you review the conditions of VWP

He got lucky.  Many people have been denied entry for less regarding work.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Croatia and Serbia are good options too! You can spend a couple of weeks there and then fly to the US. Just make sure that the layover is in Turkey and not in a banned country.

Hi,

 

Me and my fiance are planning to get married in the US the apply for AOS. He's current stay expires near the end of March but the nearest marriage license/ceremony is available on the 16 of march. 

 

Will this be too late? As his stay will probably expire before they receive the AOS application
