I was heavily questioned this time around when I entered under the ESTA. I demonstrated strong ties to home, that's why they allowed me entry eventually.

So they were already worried when you were coming for 3 months, and now you want to make your ties to home seem even weaker by wanting to come for 6? I mean, your decision if you want to apply for it, I just think it’s potentially endangering your main chance of seeing her. Again, if your B visa application is refused you will not be allowed to use VWP any more. Actually that will probably also happen if an F visa application is refused come to think of it.

Yes this is a good point too. I do have a job offer from a sponsor in the u.s, that was the original plan, but we just can't find a visa to make that work. I don't qualify for the e3 and the eb3 is going to take 2 years to process, which is too long.

Being refused a B does not bar usage of the VWP, it does mean you need to apply for ESTA  again, tick the box which asks about being refused a visa and that can cause issues.

As I mentioned in your other thread you need to speak to your prospective Employers Immigration Lawyer.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

Yeah it seems like I might need another option  after reading these opinions, unfortunately we don't want to rush into marriage!

Maybe she can move to your country?

That's not how that works.  Please do some reading up on employment-based US visas.

Its just tough with Australia being closed at the moment

But immigrants can get in from what I understand. Does Australia offer visas for partners/common law spouse?
