Hello all, I am legal alien with work visa. Found an error on the mortgage application that bank had checked U.S. citizen for me. It was before closing. I asked the bank to fixe it. The final information on the loan were correct when signed. 

I'm just wondering if the original wrong form would be considered false claim to USC at all.

Hope I'm just overthinking. This cannot be considered a "claim" in anyway, right?

It's not an issue because you fixed it and you still qualified for the mortgage as a non-citizen: https://www.uscis.gov/policy-manual/volume-8-part-k-chapter-2 "Furthermore, U.S. citizenship must affect or matter to the purpose or benefit sought. That is, U.S. citizenship must be material to the purpose or benefit sought."

No, it is not considered false claim. First: you did not claim anything, it was the bank mistake and you corrected it. Second: you have your mortgage with the correct information.

Not an issue. You didn’t claim to be a USC, someone else assumed you were without checking with you or someone misunderstood the term “legal alien”. You will find that many people, particularly in the finance industry and at the DMV it seems, do not understand the differences between “resident”, “citizen” and “non-resident legal alien”. 

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

This is uncanny. I found out about the mistake on the same date as that guy.

It's not that weird. The rates are super low right now and everyone is refinancing or buying. With so many mortgage applications mortgage companies are overwhelmed (and maybe hiring new and inexperienced people), mistakes like this happen. 

 

BTW, I've applied for a mortgage 3 times now with 3 different companies and somehow they all knew I was a permanent resident each time and asked me for a copy of my green card (I never told them) while they didn't ask my husband for a proof of citizenship. No idea how they knew.

It's been a journey! When I noticed and corrected the mistake on the mortgage form, I didn't even realize it's such a big deal. After I researched further, that's when I started getting panicked.

I studied every case on this page https://www.uscis.gov/policy-manual/volume-8-part-k-chapter-2. The interpretation could be really broad, especially if you read the last example under Point 3 Intention to Achieve a Purpose.

I also emailed a few attorneys. And just like the other guy, I asked the bank to provide a confirmation that I did not give them the wrong info. 

I wish I came to this forum earlier. But it was not prioritized by google and I just found it.

 

I'll move on with my life now!
