Please Help!!! Received 10 year GC but N400 DENIED

I asked the same question to myself. The first thing USCIS look as far as showing financials as a married couple is tax returns along with other financial statements. It`s not my place to question someone`s decision but it does not seem wise not to. To each their own of course.

The N-400 was properly denied.  They are not living together.  That's a requirement to file under the 3 years rule.   An appeal will be unsuccessful. Wait to file under the 5 years rule.

Iam not exactly sure. Financial reasons maybe? He has 3 kids, she has 4. They do the married but filing separately.

Yes. It has taken long to remove conditions. Which is why she then put in the N400 because it was taking long. They also moved case from one state to another. So that could have contributed as well.

Of course, it is their decision, but I can't think of any benefit......I might be missing something.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Good point.  As a resident of Texas, I sometimes forget about those......Thanks.

Meh, not really. MFJ vs MFS is a personal tax decision.

Even USC-USC couples may file separately in specific tax circumstances, or if one of them has a significant tax debt and they don't want to be liable for it. It doesn't mean the marriage isn't legitimate, or more precisely, that the marriage was entered into for the purpose of evading immigration law.
