Hi, Everyone!

 

I have been browsing through this topic for some time now trying to piece together my next step in my Visa process. My Conditional GC expires March 2021, and I will be filing to remove conditions in December some time. I know with Covid-19 things will get delayed like they already have. 

 

I have read that form I-751 can take up to a year to process. This is with people receiving Notifications and having their finger prints taken.

 

My question is, what happens when my CGC expires?

 

I know I have to wait at least 3 years to apply for Citizenship... but won't this technically make this 4 years?

 

Its all a little confusing. Any info you guys have I would greatly appreciate it. (Sorry if this has already been answered)

When your GC expires you will be sent a document that extends the validity of your GC for 18 months. You must carry this paper along with your GC when you fly internationally. Regardless if your 10 year GC is in hand; you can apply for citizenship when your 3 years as a permanent resident (as long as this is a marriage based application) occurs- it is possible you may have a joint interview for ROC & citizenship if ROC had not been approved yet. Check out the ROC and citizenship boards on VJ- plenty and plenty of people go through this.

Just wanted to clarify for the OP that this extension is the receipt for sending the form I-751. So you don't get it when your GC expires, you get it when you send the form :)

Yes, you send the I-751 form with more evidence showing that your marriage was bona fide and once USCIS receives your packet, they send the NOA and the 18 month extension letter.

 You will reach your citizenship eligibility about January 2022 (based on your timeline) if you are still  married to your petitioner. Otherwise it will be January 2024 if not married to petitioner. But you can count on slow processing timelines dragging it out before you actually get that naturalisation certificate.

I was going to say that too. The way things have been lately, getting approved in a year would be lucky, be prepared for a longer wait than that.

 

There's a reason the extension letters used to have a 12 month validity just a couple of years ago, but is nowadays valid for a long 18 months..

I knew it was longer and the extension letter is 18 months.
