When to remove conditions?

I was reading the instructions (skimming through while at work) for the form I-751, the Petition to Remove Conditions. The instructions say: 

Quote

Filing jointly. If you are filing this petition jointly with your spouse, you must file it during the 90-day period immediately before your conditional residence expires.

 

My husband's visa expires in 2029. Does this mean he can't apply to remove conditions until 2029? Can someone please provide me with info/advice?

Your husband was clearly granted a non-conditional greencard (not visa) so he will never have to remove conditions. His is already non-conditional.

 

Are you saying that he was supposed to have received a conditional? Sometimes USCIS makes mistakes. 

 

EDIT, I just checked your timeline and it appears that you two had been married over 2 years when he entered the US. So he got a 10 year non-conditional greencard, that is all correct. Removing conditions doesn't apply to your husband.

i don't know if it's because i am fasting or what but my head was completely in the clouds for a moment. i wanted to look to see what was the next step for my husband to become a citizen... i looked at our timeline and it said form I-751 so I just jumped on it's boat. THANK YOU and I'm deleted my question so no one else starts telling me!! haha

it won't let me delete it, everyone just ignore 😄

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

If you have a 10-year green card, then the next step is to apply for US citizenship (N-400), if you want. Otherwise, every 10 years you will have to renew the green card.

 

By the way, you don't have to wait 10 years to apply for US citizenship. You can do it now and you can do it online.

I think that just auto populates whenever someone selects CR-1/IR-1 visa. Thankfully you won't need to do any ROC!

No,  he can't /  he came in April 2019  and would have gotten the green card after admittance

 

Have been a Lawful Permanent Resident (Green Card holder) for at least 3 years

 

He needs to follow the rules under married to US citizen from USCIS

You are right.

Even though the next step is to apply for citizenship, he has to wait another 2 years.
