Stimulus payment for foreign wife of a U.S. citizen

So, non-immigrant visa holders like H1B and J1 get their stimulus checks while US citizens like me do not.

My only “fault” it seems to having filed MFJ with my foreign husband who has an ITIN.

Don’t you just love this!

No they don't get the Stimulus. H1B and J1 don't file 1040s, they file 1040NR, which is clearly excluded from the Stimulus package.

 

Remember that you didn't get the money early. In 2021 when you guys file taxes, your spouse will definitely have an SSN and if you still qualify, you're getting your stimulus.

  H1B’s are usually going to meet the substantial presence test and file as residents.

This may have been already answer in another thread but I am not sure so I'll ask.

I came with a K-1 visa a few years ago and already working on renewing my green card; wife and I do file together (and have a kid, yay us!). When wife brought me over she signed as my sponsor (and IIRC) she is financially responsible to pay back any benefit I may apply and get from the government. If we get $2900 (1200 for her, 1200 for me and 500 for baby),  does that mean we have to return $1200 that we receive for me?

If she signed anything related to that, it was not for immigration. :)

Certain benefits immigrants qualify for. Certain benefits are covered by the I-864.

This is not one covered by the I-864.
