Documentation to remove conditions

To remove conditions it says we have to send as much documentation as possible to prove our marriage is legitimate. The only documentation my husband and I have is our marriage certificate and the joint tax return we filed. We live with my husband's family so have no joint bills etc. I'm worried it's not going to be enough. I was thinking of opening a joint bank account, but any other ideas would be welcomed. 

Also, do we still have to meet the same minimum income requirements that we did for the initial spouse visa? My husband and I are both laid off right now.

Wills and living wills are an idea.  Joint credit cards, joint car insurance or health insurance.

If you try to make any new joint documents when the deadline is coming, it will create red flags. You send what you have, don't try to make more documents to make your application thicker.

 

I-751 doesn't need financial support so you are good. Good luck.

For ROC, your income isn't looked at anymore. 

 

Do you both have driver's licenses with the same address? Insurance (health, car, life) in both of your names? Can his family provide a statement that both of you live there?

Wife's Military Dependent ID card showing me as the sponsor.

Military pay statement showing wife as my benefic.
Texas Health Care Directives appointing each other as sole health care proxy(Advanced Directives)

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Instead of focusing on what you DON'T have, be creative with what you DO have.

 

In your cover letter, you will need to address the fact that you don't have a lease/mortgage together.  Since you live with his parents, they should create an affidavit explaining your living arrangements.  If you give them any money to help with groceries or utilities, they should mention that. 

 

If you do not have any joint accounts, how to you pay for things?  If you both had paychecks, did you each have your own account?  This is not a show-stopper - but your cover letter will need to explain that you do NOT maintain joint accounts (perhaps you pay for some bills, and he pays for some other bills?), and that <describe this> is how you pay your bills.  Lots of couples do not co-mingle finances because of various reasons (included different spending habits, problems with credit, problems from the past, bankruptcies, etc.).  You just need to be upfront about it, or you WILL get an RFE.

 

Do you have cell phones?  Are they under one account?  Under a family account?  If under a family account, can you get a copy of the statement that shows both phone numbers in the same statement?

 

Do you have any mail addressed to both of you?  Wedding invitations, Christmas or anniversary cards?

 

Do you have ANY insurance together?  Are both of you listed on his parents' homeowners' insurance as someone who can file a claim?

 

How do you get around?  Do you have a car?  Driver's licenses with the same address?

 

Really - sit down together and think of your life together - financially, physically, etc.  Then figure out how to prove it, and explain how you pay for it.

 

You will be among many who are trying to remove conditions in a time when many people are out of work.

Do you go to the library or the gym or have any other kind of joint memberships (CostCo, Sam's Club, BJ's)?  Photocopy BOTH cards and show how you pay for the memberships.
