All Nebraska I-130 Filers -- Part 6

Hi everyone,

 

Not sure if there is already a topic opened about this I just did, but I also want to pop the question here. I booked my trip to the US on January 28th. Me and my husband (US citizen) stayed with my family in law in Florida, entered the usa on March 2nd.  From that day the Corona started to spread heavily and it resulted in to a canceled flight back home. There were no direct flights back home (Netherlands) I either had to stop in Mexico or Spain, which I didn't feel comfortable with. (I don't want to be stuck in a another country). We decided to travel up to New Jersey. New York offered direct flights back home. I booked one for the 3rd of April. You can guess, canceled. Now the spread has even gotten worse here in New Jersey, but also in my country. Everyone says the best thing for me to do is to stay until it gets better and I don't feel comfortable flying now at all. But I have to leave the country by June 2nd (ESTA). Since we have a pending CR1 visa, I don't want to overstay. But what happens if I get sick or there will be a complete Lockdown, here or in the Netherlands. Crossing the boarding in Canada or Mexico is impossible, they wont let you cross now. Anyone with a similar story with more answers than me? Please help me out.

I called last Wednesday and requested expedited processing based on clear USCIS error because they transferred my case and didn’t send me notice of transfer. 2 days later they approved my request to expedite and today they approved my petition!! Good luck everyone! 

Congrats! My PD is also September 2019. How did you expedited based on USCIS error? My case is transferred to Potomac service center but I haven't received any notice so if you don't mind can you tell me how did you expedited? You can PM me if you  want.

As of right now, the US has not announced mass, automatic waivers for ESTA holders who are forced to overstay (or simply cannot return home). 

 

Other countries, like Spain for example, instead, have told US citizens that the days they spend inside the country during the State of Emergency will not be counted to determine whether they overstated their visas.

 

Violating the terms of your ESTA could have catastrophic consequences for your I-130. I understand you don’t want to fly for obvious reasons.
 

You can try to get a “Satisfactory Departure” from either USCIS or CBP (it’s unclear who is handling these right now during COVID in your specific jurisdiction). You can also try the CBP office at any international airport, though you mentioned you want to stay away from airports. This satisfactory departure may provide a waiver to allow you to overstay your ESTA for extreme reasons without prejudice. But it’s a case by case petition.

My wife (Chinese) is in the exact same situation except she has a tourist visa.  I applied for an extension of her visa.  Cost over $500.  Must do biometrics but all offices closed.  Her stay time expires May 19.  I hope the offices are open by then.

Did anyone else get a status update? Mine was updated with yesterday’s date. 03/31/20. I hope this is good news. I spoke to a live agent this morning and no transfer. PD Nov5, last update was Feb23 until yesterday.

saw on facebook someone with PD from Feb of 2020 got approved, I wonder if they have started another pilot approvals like early last year.

Thank you! I called USCIS call center and pushed the correct buttons until I got to the option to request expedited processing. I believe it comes after the automated system tells you the status of your case. I then only said I’d like to request expedited processing based on USCIS error because  my case was transferred from one service center to another and I never received notice that it was transferred. I thought it was a long shot but it worked! Good luck!

Sounds like coincidental timing.

Clear USCIS error is a criteria for expedited processing and they expressly approved my expedited processing request.
