Was the Beneficiary Ever in the USA?

 

Is it enough to give just the Passport Number since my Beneficiary was in the US?  Since she traveled 10 years back she does not have the old passport and any I94 details. Do we need travel document Number and I-94 Number?

Just answer yes.  The rest of the questions are for if she is IN THE USA NOW.  Read carefully.  Interpret literally.  Answer accurately.

I'm surprised this question comes up so often........These question are literal......

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

When she traveled to the US was she in the US?   Yes or No.

 

Is she in the US Now?  If yes provide the info.

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

I hope I'm not sounding rude or anything, but have you guys filled out the Online version of the Form I-130? You are trying to help someone by answering there question, but you guys are just being rude!

 

I think the person asking the question is doing the online filling version of Form I-130. If you look at the image below, it just ask for your beneficiary's passport number. There is nothing that says if your spouse is in the USA or not. The paper version of the Form I-130  has instructions that says that.  For the online version, If you answer "Yes" in if your beneficiary was ever in the United States, you go to a new page and it ask you for your Form I94 details. It's very confusing. If you answer "no", it skips that part.

Here is what I did, since my wife is a very special case, I answered "NO" because the immigration officer denied my wife from entering the country in a US airport. So from my understanding, she was never in the United States. However, since it's asking for your beneficiary's passport number, I put her information in. I left the travel document number blank because my wife's travel document number is her passport number. I talked to one of the USCIS people and they said the paper version should be the exact same version as the online version, so I'm guessing you can leave it blank because your spouse is not in the United States anymore.  There is an "additional information" section where you can explain your issue.

This is a good question. A lot of members have been on here for years (and their expertise is invaluable) but it seems there is a disconnect sometimes with the new online filing process versus the paper-packet version. I think eventually it will sort itself out as we all figure out the nuances. The "additional Information" is very helpful! Also being aware that once you submit your online application USCIS is not required to consider any additional information you add after you submit your initial online application. So make sure you have all the relevant information uploaded first.

Yes, it is a good point.  There are many problems with the online form and members who haven't used it are not well versed in it.  I'm still old school enough to recommend using the paper forms anyway.  That way you KNOW what you sent. It's far less cumbersome.  The online form may be convenient for USCIS but until it's been through some revisions to remove "bugs" it's far LESS convenient for petitioners.

I have done it both ways. I prefer the online. My first experience was years ago. Submitting that package and making copies was so time consuming not to mention sending the whole package via DHL was expensive. This way, all my docs are already in PDF form so she can print off all our documents with my login info.
