Possible divorce while sponsoring my parents?

Hey guys.. it’s a sad topic but it is what it is, and I would love your opinions on this topic.

 

My husband and I have been together for a really long time, since 2012 senior year of HS, and been through a lot. Unfortunately, as life goes we’ve decided that we don’t see our relationship moving forward. Nothing crazy, but we’re both about to graduate with engineering degrees and... our lives are just taking us both in different directions with different goals and aspirations.

 

I recently became a citizen, back in July, and since started filing for my parents to obtain green cards (they already live in the US through e2 visas.). I started filing for them in August.

 

My husband and I are considering whether it would be wiser to stay married until they complete their filing, or go ahead and start the divorce processes now. What are your opinions? He, neither I, want to hinder my parents processes in the green card obtaining.

Jan 12th, 2016 - Bio-metrics completed!!

Jan 15th - RFIEEE!!!!!!!!!!!!!!!!!!!!!!!!

Feb 23rd - RFIE response mailed back
Feb 26th - RFIE response received
March 8th - EAD/AP APPROVEDDDDDDDDDDD!!!!! (On my birthday too~)

March 16th - Card received in the mail~
May 17th - GREEN CARD APPROVED!!!! NO INTERVIEW NEEDED

May 23rd - NOA approval in the mail

May 25th - Green card in HAAAAAAAAAAAAAND

Future ROC filing date: Feb 16th, 2018

You're as a US citizen can sponsor your parents anytime you want. Your husband has nothing to do with that

No yeah I completely get that, it’s just we were reading some forums that say that immigration can reopen your case if you file for divorce and potentially revoke your citizenship. 
 

I have an unreasonably anxious fear of immigration in this current time policy 😅

As long as the marriage was entered into good faith by you, there is no basis to look at your citizenship.  The only issue around the divorce would be if you have enough income / assets to sponsor your parents (for USCIS) and enough to offset any public charge concerns (due to the age) of doing consular processing.

 

If they are here on e2 then they probably have enough assets to self sponsor and adjust.

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

revoking a citizenship is much harder than revoking green card. your case is fine

To be honest.. I don’t remember my husband signing anything in the sponsor forms. Even the income portion was entirely me, none of his.

What matter is your income. Not sure how far you are in process, NVC Will ask for your most recent taxes. If they will get interview this year. File 2019 jointly or even separately as long you are above poverty line. Your parents visa isn’t depended on your marriage status. If income is an issue, you can use you siblings income to back you up. (Affidavit   support)

If I’m not mistaken, the official date on file where the papers started getting processed was in September, and about a month later they had to do biometrics. I currently have a part time job, and full-time university. My parents have a company set up here in the US, and they make well above the poverty line. Do you think there’s a chance that my income would even be vetted?

If they have their own income to support, that’s great. I haven’t been in situation where person being sponsored has its own good income, but I don’t see any future issues with that.
