I-134 dependents information

Timeline

My USC fiance is a divorced man and is now living in his mother's house since he got divorced.. he has one child and still provide the child support for her (living with the ex wife, spend time with the child 3 days in a week for couple hours)..

 

So on this part of I-134 form, please let me know..

1. Does he needs to include his mother ? If yes, is it wholly or partially dependent  ?

2. Which one should he tick on the option box regarding his child ? Wholly or partially dependent ?

3. Does he needs to include me (the k1 beneficiary) as well ? And same question.. wholly or partially dependent ?

 

Thank you in advance for any kind of help that you guys will give me.

1. Does he needs to include his mother ? If yes, is it wholly or partially dependent  ?  Is the mother dependent on your fiance? Then YES otherwise NO. If YES does he provide for more then 50% the wholly otherwise less then 50% then use partially dependent.

2. Which one should he tick on the option box regarding his child ? Wholly or partially dependent ? Simpley answer the question based on either he pays ALL the support, or a portion. Answer accordingly.

3. Does he needs to include me (the k1 beneficiary) as well ? And same question.. wholly or partially dependent ? You are on dependent on him even if he sends you financial support.

3. I meant to say you are NOT dependent on him even if he sends you money so you would not be listed nor does his mother get listed as a dependent just his children.

1.  Does your fiance claim his mother on HIS income taxes?    If no .. then NO he does not include her.    

 

2.  Wholly dependent if he provides all support for the child, otherwise partially.    He should know this.

 

3.   You are NOT a dependent, you are the beneficiary he is sponsoring

Thank u sir.. but for the child point.. what if the daughter is only claimed on the ex wife's income taxes ? Then does it mean that he has no dependent and just put N/A ?

what if the petitioner has a child but does not pay child support? i have seem some say go by what is says on your taxes and some say regardless the situation if you have a child you must include them on the affidavit

In what situation would someone not be paying child support?

Timeline

   A minor child is fully dependent on parents.  It doesn't matter who claims the tax deduction , who they live with.  A child that is no longer a minor but still being supported by parent ( such as a college student ) is partially dependent.   If the adult child receives no money from the parents then they are independent.  In rare situations minors may be emancipated by legal proceedings and not need to be claimed on the forms. 

This will not be over quickly. You will not enjoy this.

There are plenty of separated parents who are able to share custody and financial responsibility for their children without the courts involved. I say this from personal experience

So did you mean that based on my situastion, my fiance should tick wholly dependent ?

even the child is living with the ex wife and the ex wife also financially contributes on the daughter expenses ?

  And if the ex drops dead tonight ?      Partial dependence is for those that could survive if the person in question stopped helping.  Like my college aged child. I am not obligated to support them but they would have a hard time without me.

This will not be over quickly. You will not enjoy this.
