Let’s see what happens with legal challenge on this. It’s currently on hold whilst it is determined if it can be legally enforced. 

 

Added - being on the HSA account is not insurance. You need to be added to his insurance plan. If he works for a company with more than 50 FTE employees he likely uses the insurance through his employer. In that case, he needs to speak to the HR department.

Thank you and at what stage would they determine this at the interview at my consulate? Or on the new Affidavit of Support form to be released Oct 15 ?

I wouldn’t worry about the new rules. Surely your husband is adding you to his healthcare anyway? He shouldn’t need a law in place to do that - it’s part of being married. Nothing has changed yet and in a spousal visa situation nothing should need to change. If he loves you surely he will ensure you have what you need here, and that includes healthcare. 

 

But if the new policy is enforced it will be determined at interview.

Most insurers require SS # to add to health care / maybe your spouse can add you without it / only the HR will know but if spouse did not do it within the 30 days of marriage ,  he must wait for open enrollment which is NOW for most of us

 

and i a surprised this new rule is bothering so many as it is just clarification of what already existed but was not put into a law or rule (but trust me it has been considered by many a CO during an interview in the past)

it has been part of what everyone has said is "totally of circumstances"

a good example would be:

senior citizen marrying as they are now on medicare and can not add a new spouse to that insurance

so, they have to be able to afford health care for the spouse

we have all needed to show (even USC) that we had or bought health care insurance since the Obama care program came out

An SSN is not required by LAW to be added to health insurance. Dumb HR or rep can request it until blue in the face, and it won't change what the law says until they get educated better.

Thank you. I have an SSN from a work visa. Also it bothers many because we do not understand what was there if it is our first time going through the immigrant process. We hear of this supposedly "new" rule but before now I can tell you I had no idea what the health care requirements are for America, so to me its all new.

I'm still wondering....  A K1 is a NON immigrant, but at what legal step turns the non immigrant in to an immigrant?  Wedding?  Filing AOS, or AOS approval, or the forth option, a non immigrant is considered an immigrant for all legal purposes of the rule.

But not new for your husband. As as your petitioner and sponsor it is his responsibility to provide this. And as your husband it’s his moral obligation also.

Well this discussion is on the CR-1/IR-1 board and we are discussing in that context. For K-1 applicants it would kick in at AOS but, that said, a CO can refuse any visa (tourist/student/immigrant/fiancé) if he/she believes the applicant could become a public charge. Nothing new there.

No, health insurance companies do not require a SS# to get health insurance.

But why is my insurance telling me that I will receive a penalty from IRS if I don't place the correct SSN/TIN #. I've been searching every law in the book for our insurance but there is no way around it. They will ask for my husband's SSN which I don't have currently.

Because either they don't understand or they don't want to deal with the hassle. But we have VJ members who are coming all the time that they were able to be added to insurance without an SS#.

Good for them but for me, I need to wait for my husband to be physically here to change anything. I can add him as "Life Changing Event". Its such a (removed).
