Affidavit of support october 15th

Hello everyone.

Please i have a question . I submitted my affidavit of support last month 27th of september along with financial and civil documents and still waiting the hear from Department of state.

My question : if NVC request correction for affidavit of support, do i need to submit new one ( New public charge rule )  after October 15th.

Or i will send the old version of affidavit of support ?

There is no new I-864.  There is no Oct 15th USCIS public charge rule affecting immigrant visa applicants.  It was delayed by Federal Judges yesterday.  There is currently a Nov 4th Department of State policy stemming from a Presidential proclamation which requires immigrant visa seeker to have medical insurance within 30 days of entry into the US.

Oct 15th public charge rule-  Currently has been stayed (delayed) by federal judges.  The new I-864 and I-944 have been removed from the USCIS web site.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Timeline

So, my understanding is that it doesn't matter whether you submitted documents before or after 15th October. If outside the USA and you are in the immigrant visa process, once Oct 15th passes, this new public charge rule will apply to you regardless. 

 

Same with the Nov 4th healthcare proclamation.

The DOS Interim Final Rule doesn't mention the I-944.

 

P.S. Did anyone download the final version of the I-944 PDF before USCIS took it down? Correct. They are adopting a lot of the same standards and guidelines, but no extra forms.

I have my interview October 15th for k1 and I'm slightly more nervous than I already was after reading this as I'm unsure now what to expect. I am the beneficiary.
