APPROVED CASE GETS STUCK at USCIS. THEN WE RECEIVE THIS RESPONSE TO OUR SERVICE REQUEST. PLEASE HELP US INTERPRET IT.

Hello VisaJourney.

 

We got our I-130 petition approved may 1st, but it hasn't reached the NVC yet.

We have submitted an inquiry to NVC research, and they say that "they are currently working with the USCIS to locate the petition".

 

When we call the USCIS, they say that they won't do anything until we wait 90 days since the petition was approved.

 

I am curios to know, if anybody else has been through this?

And what will actually happen after the 90 days have passed and the petition still haven't reached the NVC.

We have been trying to contact both USCIS and NVC, and nobody seems to want to help us.

All they say is "We can't do anything until 90 days have passed".

 

So on July 31 we are calling again.

From what I heard a supervisor at NVC say, is that they create copies of all the petitions at USCIS.

And therefor the USCIS will recreate the approved petition, and send it again to the NVC.

I called USCIS and due to us changing from AOS to Consular Processing, even though I have a the Approved NOA on the I130, we have to submit an I-824, pay a fee and wait 5 months to a year for that to be approved before they will send it to the NVC! What the h!!!!

We are going through the same thing. Approved I-130 on May 17th from Texas Processing Center, USCIS status didn't change since then,  our case appears to be "touched" last time on  24th of May . I called NVC multiple times, always been told to wait for a few more weeks and they haven't received it yet. Finally my husband calls USCIS, gets a Tier-1 rep, who tells him our case wasn't sent yet and it should now in 30 days, gave him a confirmation number. I called NVC today, again the same answer, no movement on USCIS account, nothing had been done on our request, either. Today we reached the  90 day landmark. 

 

I hope we can all  get over this unnecessary stress and extra hurdle.

Yes we have updates, so we reached the 90 days mark, and we called and the first two tier 1 rep we talked to said they couldnt do anything. On the third call wife demand to speak to a supervisor, and an hour later the supervisor called us back and said she was sorry to hear what we've been through and was going to recreate our case. She told us it could now take up to 10 days for them to sent it, and 5 days later we got a confirmation that it was sent on our online account. My wife then called again to ask what was happening next and said to wait 7 days, and she thinks he said till they receive it and they will process ours faster since we've been through. But we are not really believing it, since we've been through all this.

So tomorrow the 7 days passed, so we are excited to see what is happening.

Today I stumbled upon  this bleak article from the Nation,  ( https://www.thenation.com/article/us-immigration-is-stuck-in-the-stone-age-and-its-hurting-immigrants/ )

 and realized how deep the dysfunction goes with these institutions.

I am in the same situation. I  called USCIS earlier this week and they told me T2 support was full fort the day. I called today and the immediately scheduled a call back with a level 2 support person. Unfortunately, the "estimated wait time" for a call back was something like 1000+ minutes, so I'm basically going to be glued to my phone for the next few days ...

Wow. This is officially insane. I would try again tomorrow  to make another appointment. They are testing our marriages like a long, costly illness. Ha.

Wait, you are over 90 day period, too? Time elapsed from your approval date, I mean?

It was actually a 1000 minute wait time, which means they should call tomorrow...

 

They only refused to connect me once on a Monday. And to be fair, they did tell me to call back first thing the next morning and ask for tier 2 support.

Just received a call back from USCIS (at 8:10pm 😒, 6 hours after I called USCIS). The officer was able to see that there were two pending service requests for the case (one by NVC, and one by the tier 1 USCIS officer). She told me that the deadline to receive a reply is in 2 weeks, and to call tier 2 back if I don't hear anything by the end of August 😡
