APPROVED CASE GETS STUCK at USCIS. THEN WE RECEIVE THIS RESPONSE TO OUR SERVICE REQUEST. PLEASE HELP US INTERPRET IT.

They answered in approx three weeks both times, saying they can't find my case, they haven't received it and they keep looking. No response to their inquiry. What the hell.. LOL so they cant do anything either. Wow

Honestly, I am done with the call center. They are useless, misleading and frustrating. There is an e-request on USCIS online account page. We will do that and fillout the senator's form.

Update and a fair warning, I would advise against calling USCIS at this point ac to my experience. They don't help, they put more service requests without your consent, Tier-2 officers refuse to help then complete your  initial service requests as if they solved your issue. I couldn't put an e-request, because in our third call, an overeager tier-1 operator put another service request while keeping my husband on hold, which started another 30 day period and now i have to wait until September 28th to file an e-request.

 

We had been going back and forth with NVC and USCIS,  exhausted every venue and achieved NOTHING other than helping them buy up more time and getting worn out in the process. Still our case shows no signs of moving with the last date of  update being 24th of May, a week after our approval date. 

 

I am heading to  Senator Schumer's webpage, he is a moderate,  inoffensively  left of center Democrat  imho and a seasoned senator, I hope he can help. 

 

Anyone has any experience with Gilibrand's office?

well, let's see,  AOC is out of question, last thing i want is to get  my case  in the cross fire  of the current Great Culture Wars. hah ha, sorry, my nerves are shot at this point.

I'm pretty sure the e-request tool is just a way for you to file a service request on your own, as I used that tool to change and address and got a similar case number. Two were requests filed for the lost I130 on Sept 12 and 15, so far no movement. If I don't hear anything at the 30 days mark, I'm giving USCIS T2 one final call and demanding a reprint cases. After that I'm going to my congressperson as well. I called NVC last week for the hell of it and they even told me that I did everything by the book - waiting, calling USCIS, checking in with NVC, service requests, contacting NVCResearch, an InfoPass appt, and so on, but the file is still not even at NVC's building. They were apologetic but at this point I want results no more apologies. I can't recall how many hours total I've spent on hold with USCIS/NVC and the time spent waiting at home for evening call backs.

Actually I said screw it and reached out to my congresswoman now. I'm done waiting with this BS. They were very understanding and I have a call set up with the staff member in charge of immigration issues on Monday. In the meantime I'm going to prepare a "package" I can give them so they can quickly see our timelines.

yeah, that's what i am doing as well. Giant waste of time and the only tier-2 person we could reach said she doesnt know where our file is and she can't reprint it or send it,then went ahead and closed the initial service request, anyways. We were pretty careful to escalate our inquiry incrementally and reasonably too. But to no avail.

 

Are you in New York state by any chance?  I only saw online forms, if there is a way to directly talk to staff at the office, that might be better. Would you mind telling me how you went about it? You can pm me if you don't wanna post here.

And, yes, you are right about the e-request. But i thought it would be better if we could write down our problem without call center people putting words into our mouths or shut us down with curt, uncooperative answers.  Plus, some people on the forum reported getting an answer in a few days. so i thought it would be worth a shot.

Go to their website and see what it says. I'm not in NY. If anything I'd suggest calling - this was literally the only time I called about an immigration related issue where the phone was picked up immediately and answered by someone who at least pretended to give a s**t.

Hi again,

 

I have been reading  this forum  since we started this process on October 5th, it had been very helpful thanks to people willing to share their experiences and knowledge about this complex process.

 

We got approved on May 17th and received our NOA2 in the mail a few days after. I started calling NVC mid July and always received the same answer that our petition wasn't received yet. So we sent an e-mail to @nvcresearch as per suggested by the NVC reps I talked to on the phone and they also could not locate the file. Then  we filed another service request via NVC website and also received a similar reply, they said they received no response from USCIS despite their requests.

 

In the meantime, there was no activity on our  USCIS account, showing the last update to be on 24th of May and that our case was approved and sent to NVC

 

My husband calls the USCIS number and a tier-1 puts a service request, telling us that the file was never sent and it should now and we should give it a month for the issue to be resolved. Next day I saw this service request recorded on USCIS account with a confirmation number "currently not assigned to any officer for processing". then it did on August 16th, then it got wiped offand got assigmed again on 22nd to an officer, same or different one, we can't tell. 

 

On August 26th,  convinced this time that tier-1 assistance could not help the situation with our  case and that he should get through a tier-2, we call again. Despite my husband's requests to talk to a tier-2, this tier-1 rep puts another service request without our consent, which we later read on our USCIS account as if we are wondering why it was taking this long. 

 

On September 3rd, as per my instructions, he presses on to speak to a tier-2 rep and succeeds to get a transfer this time. After he tells the basics, asks her about the location of our case and whether it could be reissued /resent. She rather curtky says she can't, that she doesn't know where the case is and we should receive a response by September 12.

 

AS we were prepared to put  a request with our senator today, i saw on USCIS account that the initial service request was completed and the second one is now assigned to an officer. It still shows our case as approved. 

 

Then my husband receives this correspondence that we have no idea how to interpret as there are various incongruities.   Firstly,  our inquiry was not about an approval notice, we already have that, our inquiry was regarding our approved case and our request to locate and send it to NVC. NVC also was notified with the I-797 a month ago. They told us that USCIS did not respond to their request to locate and send the case.

 

 

Secondly, the USCIS account still shows our case as approved on 17th of May with the last update on the file to be 24th of May, with a new service request assigned to an officer.

 

So they approved then retracted their approval? None of us have a criminal record.

 

Please help. We are getting desperate, this is getting way too out of ordinary and we have no idea what to make any of this.  Is this time to get a lawyer or just wait even more? We are on 112nd day since the approval notice.

So is it approved, is it not? IS this  some sort of a Schrodinger's petition?

 

My husband said the tier-2 had a distinctive accent, he is a native speaker. Did she misunderstand our service request, if so, how? Doesn't she supposed to see our case in front of her?

 

IS this another way to say they totally lost our case?
