If my kids live in the other country with their father, how long would they be allowed to live with me during visits in the USA?

However long CBP grants them at POE, as dictated by the I-94. Usually this is up to 6 months, but it could be less.

Every entry is at CBP's discretion.

That is determined at the point of entry. They will need to have ESTA or visitor visa.

They also can’t visit too frequently or they can lose their visit visas. But I presume they are in school so that will limit the amount of time they can spend with you anyway, to what should be ok for tourist visits?

From your earlier posts, I recall you were planning to bring them over as K-2s, right?

Reading between the lines of first post, father has not given permission.

Father did not give permission and they are staying with him for a year in my old country. I'll therefore forfeit the follow to join option.

Sorry to hear.  What happens when the year is up?

Then the dad decides if he'll 'share' or not. But if I130 takes up to 7 years, as I've read, then what's the point. Sigh.

Not for under 21, which they obviously are. More like 2 years. I’d suggest you file the petitions as soon as you can actually so that that clock starts counting down.

Will the Father agree to a visit, and if so for how long.
