US Citizen Living in Foreign Country with Spouse

I would defer to @Jeanne Adil  She definitely lived the experience!     Her husband's immigration was nothing like ours.

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

It's US Embassy, but it is the Immigrant Visa Unit.  I know that.  This is a 22 year old woman.  Totality of circumstances are what matter most.  If she was unemployed and 45, and he was 25 or 30 etc. these things would be relevant.  THIS relationship seems to fit cultural norms, PLUS she is LIVING THERE WITH HIM, which pretty much trumps everything else.  Context is KING here.

I don't have a job but i live on over $10,000 a month from an annunity and even i did tax returns ,  all i pay taxes on is the interest and NVC kept making me do the AOS over and over til i hired an attoney who showed my annunity and  that my husband would inherit is

So you are saying that once you had the Affidavit of Support sorted out and submitted properly, all was well.  Yes, that is a key requirement.  Having a job or going to college would not be a requirement.

We used a parent’s address because everything was already addressed there.

 

Physical address was foreign address.  Permanent address was US address.

 

I can’t comment on sponsorship but assume your co-sponsor should make enough to suffice.

#1. For Part 2 information about me, can I put my address back home as my physical address or should I put my address with my husband in Morocco? 

 

#2. In regards to the I-864 I am unemployed so I will have my father be the joint sponsor. But my concern is how I file I-864 while abroad? I have read that to file the form one must be domiciled in the US. Well of course, it is my permanent home and I'm just living in Morocco with the intention to be with my husband until his visa is issued and we can go back together. Because of this is it seen that I am no longer domicile? If so what do I do? Or is it really an issue because I will have a co- sponsor?

Hi, I filed under the k1 and married here. Not working shouldn’t be an issue. I barely had begun a part time job and my best friend, who is in the military, sponsored us. It wasn’t even a family member. You’ll be fine as long as you have a sponsor. Like the person below said, answer honestly and truthfully. Once my husband and I got here we both finally obtained full time jobs and I finished school online. Best of luck and I wish for you a rapid process!

Thank you for your input. You have a good friend! Yeah when I return with him working full time is my goal as well as finishing my BA! Thank you for the encouragement!

most countries are ok but for Morocco you really need to be here with an income

joint sponsor helps but still Casa embassy expects to see the USC with a job 

since you are willing to live there now (and none of us want to be separated)   the embassy will say ,  you don't need a visa ,  you can live in Morocco

it has happened to others 

 

not trying to be hard but i worked 6 years for a visa for my Adil and i know what can happen

 

and don't use the moroccan address 

I agree. Unfortunately no one wants to be separated from their spouse for long periods of time but I think you will have an uphill battle and will end up having to come back to the US anyway after a denial. My husbands journey was much shorter than Jeanne and Adil's, but hard none the less. Morocco is notoriously difficult. I've got a long list of friends who were separated from their spouses for 5+ years. This is not an easy process - so you need to do everything you can to balance things hopefully in your favor. Just my humble opinion, take it for what it's worth.
