CRBA denied, wife coming in 2 months,w hat about baby?

Hi everyone. I am a US citizen by birth and I have 2 years old baby boy in another country he born there. I was trying to do CRBA for him but was denied. Because they ask me of last 5 years presence in US and 2 before age 14. And my wife will be in US in 2 month. My question is. Is their any way she can come with the baby. We don’t have no one to leave the baby with. Thanks

I found a past post from you that stated your wife went to her IR visa interview in Dakar around the 3rd week in March.

 

 

Did she not take the baby with her that day so that he could have been included in the petition? Did she not take birth certificate to show that he was born to you, a US citizen? I am sure she would have (or should have) listed the baby on her visa application.

I'm an idiot....you're right 🤦‍♀️....because I then contradicted myself in my following sentence. :lol: 

 

In any event, the baby could have still been listed as a child born alive etc., on the application or at least the birth certificate taken along to the visa interview.

You will need to file a I-130 petition for you child. 

 

If you wife is going to immigrate with the child you will need to push back her interview.  Most consulates will allow up to a 1 year delay for the interview.   

 

Alternatively,   your wife can come to the US briefly to activate her green card and then apply for a re-entry permit that will allow her to return to your son to await his petition.

 

Is there a reason you did not petition your son?

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.
