JULY - AUGUST 2019 I-129F FILERS

Hello all...The truck is in motion and we have received our NOA1, but I wanted to run something by you. I am Petitioner and my fiance and her toddler son and I have previously pursued the K-1. In 2018, we received notification that we were in process to NVC, when I was laid off. I was out of work for a significant time and we essentially abandoned the visa. Fast forward to now...I moved and actually making more money than the last job, so win win. 

 

My question, does the 2018 submittal and subsequent non completion hinder our chances now? My fiancé and I have known each other for about 15 years and I provided photo evidence dating back 10 years.  Is there anything we should focus on in the event we do have more control of the situation (ie. we make it to the interview and we should focus the conversation along with our history). Any other insight you can provide, will be forever grateful. Thanks for any input you may can provide. 

If you just abandoned the K1 without withdrawing it, it's going to look badly on you.

Well...now that you say formal documentation, I went back to review a full digital folder of all documents used, sent, and received by my lawyer when we filed last time. He was leaving private practice and gave me everything he had so we could re-file on our own now that I moved and gained full employment. The last formal document I see is the notification that our file was being transferred to NVC. I did notate the previous case number on the current I-129f submittal and explained the whole work thing that took us well beyond the timeline by 3 months. I’m hoping since the previous cancellation is with the same person and she and I have extensive history (documented), there won’t be any issues. I did some searching on the internet and am getting mixed answers on whether or not I should be filing a waiver. Some folks say since it is with the same person, it’s not nearly as big a deal I guess as a marriage broker situation. I’m very willing to do whatever needs to be done to continue the transparency of our situation. It may be out of our hands. Thanks for the feedback.

The PSA in the Philippines is notorious for misspellings and missing information on birth certificates. You should look over your BC to make sure everything is correct as well as your passport. Now is the time to get that corrected. You might want to get a copy of your NBI to see if there are any problems with it. Again, now is a better time to get it corrected if you find something wrong. Be sure to use all your AKA's when they do the search. Make sure your passport doesn't expire any time before a year from now as this is a long process and you could be running around getting a new one at the last minute. So get it renewed if it is expiring in 2019.

 

Also, there is a sub-forum for the Philippines here on VJ that you should be a part of. It's a good place to read what others are experiencing which will only prepare you for your interview.

@payxibka has a good handle on waivers. I just summons him for your answer. That's one area that I am not well schooled in.

Nothing you can do now because you have filed.  The uscis will determine if a waiver is needed and if one is, they will send you an RFE.  A waiver if required,  is easy.
