Brand new here with work visa question

I guess another factor in my reasoning is, the worker would be getting paid for a full time wage, but not required to work full time. We live in a 1800 sq ft duplex. At most the worker may have 3-4 hours of work per day. I assumed minimum wage would be fair since a large part of the community here gets paid minimum wage. We rent to family who work minimum wage jobs and they seems to make it. I can’t believe the word slavery and servatitude are being thrown around.

 

Of course we would set them up for the winter conditions. This isn’t the movies. I’m not trying to pay someone $8 an hour and then nickel and dime them for everything. Now, if the worker wanted to go out and see a movie, have a drink, etc, that would be own their own dime. 

 

I would think the incentive to remain ongoing would be that even though they are only making minimum wage they wouldn’t have a single bill to pay here. 

 

You get what you pay for, I have seen and talked with a lot workers here getting paid 40-100 pesos a day ($1-2 USD). They are happy to be working and go out of their way to ensure the job they do is done correctly. It’s a different mindset in these parts.

You will need to ensure that's detailed in the employer/employee contract (along with the pay rate) so there's no misunderstanding and also to protect yourself (and her).  If the hours stated in the contract don't match what she's actually working (ie. you put 3-4 hrs per day, and she end up working 6-8 on average), she does have an avenue to report this.  Alternatively, she cannot demand being paid for a whole day if she's contracted to work 3-4 hours, and that's what she actually works (which protects you).

They wouldn't have to pay room and board, no...but they would (presumably) have clothing expenses, cell phone bill, entertainment expenses (I'm not talking weekend trips to Las Vegas, but surely they won't be spending every moment of their free time in their room at your home), public transportation expenses (unless you plan on driving her everywhere she needs to go during any free time), out-of-pocket medical expenses (chances are at some point during her employment she'll need to see a doctor for some reason or another), personal items expenses, personal food expenses (some live-in nannies/housekeepers from time to time buy extra food for themselves, as they feel somewhat "watched" over how much family groceries they consume).

 

I'm not mentioning the above to harp on you about anything---just to give a fuller picture that she will have expenses even if not paying rent.  The CO will be taking her cost of living into account when looking at the contract (and what you are stipulating as her hours & salary), not just "well, she gets to live rent-free in exchange" when determining whether to approve the visa.

Have we determined the route?  I know OP needs to consult with his favourite Immigration Lawyer as this is not DIY, I was leaning towards EB3 and that would allow other work to be undertaken or if needed a completely new job.
