Good Morning y'all...so my fiance and I petition for K1 visa has been approved and we are now ready for the next step from NVC. The thing is my fiance doesn't keep money in his bank account but he has his regular job and make 36,000 a year plus he has his side business and make almost the same from that. My question is since he doesn't keep money in his back account...for the affidavit of support will this in anyway affect us when we go to the embassy for interview. My fiance has decide to take time off work to come to the interview with me.

I don't think how much money you have in the account matters. When my fiance had his interview the lady didn't ask for bank statements ( but I had them on hand just in case).

It very well could in the absence of other good supporting evidence . Current income must be documented.  I suggest he supply a letter from his employer and other evidence as described in the USCIS instructions.  The Consulate Officer will make a decision on the public charge aspect based on the whole financial picture.

 

From the official I-134 instructions:

"As the sponsor, you must show you have sufficient income or financial resources to assure that the foreign national you are sponsoring will not become a public charge while in the United States. Evidence should consist of copies of any of the documents listed below that apply to your situation. Failure to provide evidence of sufficient income or financial resources may result in the denial of the foreign national’s application for a visa or his or her removal from the United States. Submit in duplicate evidence of income and resources, as appropriate: A. Statement from an officer of the bank or other financial institutions with deposits, identifying the following details regarding the account: (1) Date account opened; (2) Total amount deposited for the past year; and (3) Present balance. B. Statement(s) from your employer on business stationery showing: (1) Date and nature of employment; (2) Salary paid; and (3) Whether the position is temporary or permanent. C. If self-employed: (1) Copy of last income tax return filed; or (2) Report of commercial rating concern. D. List containing serial numbers and denominations of bonds and name of record owner(s)."

So, he earns about 70K a year, but doesn't "keep money in his bank account"?  Does that mean he doesn't deposit the money or does that mean he spends it quickly?

Assuming your visa is approved and you land in the US to marry, in 2 years you will need to file removal of conditions, where you will be required to submit joint banking information to show you are financially commingling, so opening (and regularly using) a bank account is going to be something you both need to do.  Just so you’re prepared because it is not the norm for a working adult to not have a bank account as the vast majority of employers provide payroll via direct deposit. 

 

For the embassy stage, I didn’t have to provide banking statements, but my husband (then fiancé) did have a letter of employment and paystubs, as well as tax return transcripts.

No worries he doesn’t need to provide his bank deposits as long as he is earning what you are saying. All he needs to provide is few evidences of income.

I think it meant he only files taxes on the $36k that he earns on his regular job and not the "side business"

That's the only thing I can think of. I mean, if the fiancee is filing tax return on $70k income, it would have been a slam dunk, no need to ask question here. No need to disclose assets/bank account.

JA doesn't care about bank statements.  They want checkstubs, W-2s, and taxes as proof of income.
