Hello guys my u.s citizen wife living with me in India for past 4 months and we also got registration with frro and she's on x2 visa for a year. She also previously stayed in India for year and went back to USA. This time She is not going back to USA without me. And we decided to  send our i130 file to Chicago lock box from India. Are we doing good? Need your advice guys.

The process from filing to visa in hand will take 12-18 months.  She will need to provide evidence of US domicile, and she will need to be current on her US taxes... If her current US income is not sufficient, she will need a joint sponsor.  This process requires a great deal of knowledge, planning, time, patience, and money.  You have come to the right place for the knowledge.....

You're not able to wait out the processing time inside the USA with her, if that's what you're hoping...Depending on timing when her visa/duration of stay in your home country is up, and 1-30 processing time (12+ months average), you might have a bit of separation.

But she is not up to her taxes from 2016. The last tax is paid is on 2016. And after for year she was in India with me and than back to USA for 6 months and now again in India. We have joinet sponsor but her taxes are not up to date. So what we can do??????

She MUST either file back taxes or explain why she wasn't legally required to file her taxes.  If she has income above the required limit for filing, she MUST file.....no matter where she resides.....and regardless of where she earned the income.

File the taxes.  Remeber tho it is not needed until later in the process.

I didn't know if OP presumed he could enter the US with her when she returns just because they filed the i-130.

She will need to get current on her taxes and establish domicile, including a job with US-based income, before you can come here.

It’s more than just an I-130. There are other forms and documents you need to send to Chicago.
