salam

My priority date is June 2007. My case status is currently case is at NVC.

How much more time will it take for our visas?

My son was 14 in June 2007. He is now 25 years old. What will happen when the file will open if my son is 26 or more? Will he be eligible or not? How much time is left?

Incorrect.  If the OP was petitioned by a sibling (and is, therefore, an F4), the derivative son is also F4.  If he ages out before the Priority Date (PD) is current, he has no category until/unless the parent then petitions for him after they enter the US on their own F4s.

 

OP -- you need to find out when the petition was approved to see how likey it is that he will still be eligible when the PD is current.

Son is clearly a derivative on an F4, OP talks about “our visas” and whether son still eligible. 

 

More info needed to see if your son has aged out - need approval date. 21 not 25 is the key age but there is an adjustment made which we need approval date to calculate.

thanks for reply and tell me how can i check. i dont know approved date i only know the priority date 18 june 2oo7..and this letter i recived on 2010..

The 2010 letter is probably the approval one - what does it say and what is the exact date?

however - if it is the approval letter then unfortunately your son has already aged out. We could confirm properly with exact birthdate and approval letter date.

my priority date is june 2007 and aproval date is april. 6. 2010 and youger son is unmarried and date of birth is  7. oct .1993

Unfortunately yes he has aged out. You can google “CSPA calculator” (it’s not an official website so I can’t provide the link here) and put the dates in yourself to check. CSPA effectively subtracts the period of time an application is pending (between priority date and approval date) and subtracts that from the actual age to get a “CSPA age”. The CSPA age must be under 21 at the date a visa becomes available (this is when the priority date becomes current) to receive a visa as a derivative. Unfortunately your son’s CSPA age is already well over 21, before your priority date is current. Your only real option, assuming he remains unmarried, is to sponsor him as adult son of LPR once you have your own green card. That process currently takes about 7 years. I am sorry not to have better news for you.

You've put the wrong date on visa availability date. It should be the date your PD become current. But as your PD is not current yet you can use latest current date from the bulletin to check the CSPA age.
