Timeline

Nope, it appears they used birth tourism thinking that would get them in the country. Now she is trying to change to a student visa which she can't because she is out of status. And the husband wants to come visit the US while she is here out of status. Don't see anyway this is going to work.

She has a USC parent? That would be about 7 years I believe. Faster if a law passes to move the backlog faster. I remember it was 4 years wait back in the days. 

I said IF she has a parent or sibling that is her only option.  And she’s married, so 13 years not 7.

She can’t get a waiver with no one to sponsor her ....right? I’m trying to figure out how you  get to waiver without that first step.

Now a US citizen!

I did not see you mention ‘IF’ initially but now we are cleared. Thanks. No waiver without a sponsor.

Does she have a shot at a U visa? Has she been a victim of crimes who has suffered substantial mental or physical abuse while in the U.S. and willing to assist law enforcement and government officials in the investigation or prosecution of the criminal activity?

 

You see where we are going with this? Devolving into absurd what ifs and conjecture and grasping at straws that will snap immediately you hold on to them.

 

Successful Africans I know who have thriving businesses back home have no interest in staying in the USA illegally. And she’s already gotten that prize she came for, American citizenship for her children. 😁.🤣 😁
