Hello everyone, K1 filler here and we are on our 133 days 🤗

I just finished the process of my Sharia divorce - at Cotabato Circuit Philippines.

10 months had passed and it was finally granted...

My marriage certificate are both annotated by Local civil registry and PSA MANILA.

2 months after annotation, I requested for a CENOMAR here in PSA CEBU, I went 3 times to the PSA because they told me its block on the system and have reported it already to PSA MANILA for further actions.

I went home with the same CENOMAR showing that I am still Married to my x-husband . The staff from PSA Cebu told  me that if its under sharia divorce it will "NEVER" appear in my CENOMAR. --which I wanted to confirm from those who had same experience with me before??

Someone told me to do the following once interview to USEM will takes place:

Show the consul a CENOMAR Attached with Certificate of divorce, Court Decree/Finality as a supporting documents that I had my sharia divorce done? Do I really need to make those supporting documents DFA AUTHENTICATED ( red ribbon)?

Please advice me and to those who had the same issue with me. I look forward  to hear from you.

Daghang Salamat!

First problem, You can't file for a K1 (or a spousal visa) if the divorce is not final.

Sorry about that.

Unfortunately if you filed the K-1 petition before your divorce was final, you are not eligible for the visa.  Best bet is to marry now and do a CR-1.

You should withdraw the K1 petition in writing.  Figure out what to do about the CENOMAR and then get married.  If you file a K1 and it is denied again you have wasted more time.   If a spousal visa is denied it can be appealed.  You should front load the petition with more proofs and start to comingle your assets.

Here is a case similar to yours where they filed before the divorce was final:

You need to withdraw your K-1 and refile.  You filed before you were legally capable and that will be a denial.  There have been a few of those here lately.

PHILIPPINES ONLY!!!  CFO (Commission on Filipinos Overseas) INFO - Can't leave home without it!

Congratulations. You say you got approved...I assume you mean an approved NOA2 from the USCIS. Correct?

What did you ever do about the CENOMAR? Keep us posted

Approval from USCIS isn't the problem .. they aren't aware of specific laws in the Philippines.     The embassy does know, and if you filed the I-129F before the divorce had been finalized (free to marry in the Philippines) they will deny.
