My point to my comment, and I have seen this here on VJ before, is that rather than simply helping people with their questions there are many here who feel the need for personal comments, criticism, and snide remarks. 

 

People make these kinds of decisions, and choose paths, for a lot of reasons. Personal, relationship, cultural, legal, business... etc.   Nobody here knows why someone chose to go down a certain path, but once that path is begun that person needs to figure out how to navigate the system to achieve their needs..

 

Further, sometimes circumstances change during the process and they aren't going to go back and start over so they now have to figure out some way to make this work. 

 

despite some snide remarks to the contrary. I have gotten so many different answers to this question from different people that have shared personal experiences. I have had people tell me that they hired an attorney, for instance, and that attorney was able to file some form that allowed them to travel and return within weeks of arriving on a fiance visa (after marriage). 

 

Yes, this is a confusing process with a lot of different experiences, I just asked a question but I don't think I'll be here again. Every time I've asked a question here I have to submit myself to the opinions and critique of people who want to impress on me how I shoulda coulda woulda done things differently even though they have no idea what my/our history is in this process. Sounds like their attorney filed the AP form, as mentioned in this thread---that would be the only legal way to travel abroad without automatically abandoning the AOS process (after arriving on the K1 and marrying).

If you figure the above out, I want to hear about it .  Years ago AP was just a few weeks and green cards were 4 mos. But that was before they eliminated the k1exclusion for interview.   Been there, done that

It's called AP and the current wait is 5-6 months.

 

This is the same answer you got in your other thread in September 2018.

Like others said though. Once your fiance arrives in the US, you can marry immediately and file for AOS. With the I-485 (AOS packet) you also file for work permit and advanced parole. EAD & AP.. The guides here on VJ above will walk you through it.

 

EAD/AP combo card is taking about 4-7 months right now. If she left the US before receiving it she abandons the whole AOS process and won't be allowed back into the US and you have to start all over again.... That being said, yes you most likely will have an interview for the AOS, we didn't but it is more common now for everyone to have one. So while she can travel, being out of the country for long periods of time doesn't help her in sense of AOS'ing or later ROC'ing let alone citizenship. There are time requirements to be in the US, hence point of being a permanent resident.

 

Now as to the lawyer who managed to get the AP within weeks, sounds unlikely, but it could have been emergency advanced parole;. This requires an emergency cause to have to travel. Work isn't really one so. Would need to be much more substantial reason. Usually severe family medical crisis or death.

Or it was during a time when it was true and the information he is being fed is stale

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..
