Hi, 

I'm facing similar issue. As soon as we submitted ds260, after a month May be, my name was removed. I am sure that I come under cspa. But not sure what exact steps to take, if there's any form to fill and submit for cspa. Kindly guide me on the same. Also guide me where I can find visa bulletin current date. Our case Category is f3, I130

 

My dob - 11.sept.1998

Priority date - 6 March 2009

Notice date - 4 may 2010

 

We submitted all my documents, civil, ds260 paid all the fee. I don't understand how it vanished without any notice or email from nvc. I did send an inquiry to nvc for the same but haven't received any reply yet. 

 

Kindly guide me on same. THANK YOU SO MUCH.

According to my calculations on the dates provided above you have unfortunately already aged out. The time pending approval was just under 1 year 2 months so that is the total protection you get, meaning your CSPA age is already over 21. F3 is not even current yet for your case - it is only current to August 2008, see first chart A here  https://travel.state.gov/content/travel/en/legal/visa-law0/visa-bulletin/2021/visa-bulletin-for-april-2021.html

Hi,

 

Sorry, you've aged out.

 

You were eligible to file a DS-260 under Table B of the Visa Bulletin.  However, you aged out before the Priority Date became current in Table A of the Visa Bulletin.

 

CSPA age does not lock in until your PD becomes current in Table A of the Visa Bulletin.  

 

Unfortunately, there is nothing you can do.  The law does not allow it.  When your parent becomes an LPR, they can petition for you in the F2b category where the current wait is 7 years for an immigration visa.

I'm so sorry you have aged out. I see you wrote an email and haven't gotten a response back. They might have a huge backlog. I wrote an email through the Public Inquiry form at https://nvc.state.gov/inquiry. In a couple of weeks or so when I checked CEAC website, I just saw the changes has been made.

 

Did you state in your email you're requesting for CSPA calculation? If not, resend the email and say "you're requesting for CSPA calculation AND include the full name, DOB, and IVSC number". 

 

I hope they are able to make the changes for you!

I’m answering this because you may be misleading the poster by saying you hope they can make the changes for him/her.  The poster has aged out and is not protected by CSPA. There is nothing to be done, it is not discretionary.

hello i am in somewhat similar situation. i hope i found this thread sooner. 

 

my story is in 2021, 2 wks before my 21st birthday, mother submitted fees and ds 260. my f2a category was switched to f2b. we emailed nvc and they said im in f2b category now and i cant upload anything in ceac. since we could not upload anything, mom sent docs via snail mail that time. im now 23 yrs old. i just went to ceac website to inquire if they received the documents we submitted 2 yrs ago. i did not inquire about cspa but nvc responded by switching me back to f2a. we are now able to submit the co sponsor docs, itr of mom's. i did the cspa calculator and it looks like my cspa age is now over 21 yrs old. i dont understand why my category was switched when my PD may 2018 was initially current at the time we were submitting the affidavit of support docs and now my PD retrogressed. i read on some forums that even at interviews the officer can still reject the cspa done by nvc

My child was accepted the CSPA and was able to immigrate with me. We had an interview in July 2021 and were given 221g. Had another interview on February 2023, was approved and my child was able to immigrate with me. Child will turn 25 next month.
