USC father wants to petition daughter living in the USA

Hello...

So my husband recently became a USC and now wants to start the petition for his 16 yr old daughter that is currently living  in the USA, her mother crossed the bother without inspection when she was just 1yr old.  My question is does he need to complete forms I-130 and the I-485? or just the I-130?

just another question on this case: was the child living in the USA before April 30, 2001 to fall under 245-I of that section of the law?

12/28/2018                Interview has been scheduled. Waiting for notification with date by snail mail

Doesn't sound like it. The OP says she's 16 years old today and didn't enter the US until her first birthday which would be sometime after 2003.

oh ok. Too bad, because that would have been excellent to adjust under the 245-I.  Much easier case, unless something like a father to daugther citizenship can be transfered when he turned USC. But i aint familiar with that

Even if they were living in the US on or before 30th April, 2001, they still wouldn't qualify under 245(i) since there was no petition filed by that date. 

 

OP, you would first begin by filing an I-130. After it is approved in 8-12 months they would then go through consular processing and apply for an immigrant visa in their country of citizenship, and would need to go there for it. There is no path to obtaining a green card from within the US at this time. 

 

You should take advice from a reputable immigration attorney before she leaves the US, since ceding her physical presence here gives up a big chunk of leverage she currently has.

She has no unlawful presence, since it doesn't begin to accumulate until she turns 18. However, she is still illegally present in the US (since she has no valid status).

Start the I-130 petition.

No 3/10 year bar for unlawful presence due to being a minor (and therefore no I-601A is needed).

They're unable to file an I-485 due to the EWI. They must interview abroad for the visa.

ETA: ~12-16 months from filing to interview.
