Can we use joint sponsor in form i864 for spouse?

My American wife filed an i130 petition for me

The case is at the NVC now and requesting i846 the affidavit of support.

My wife has a problem in the domicile and income

Can we use a joint sponsor in this case? or the petitioner MUST be the sponsor?

Can the joint sponsor be my brother-in-law who fulfills the domicile and income conditions?

Thank you for your help.

hi

the petitioner is the primary sponsor and must file an i864 regardless of income. she can have a joint sponsor

it can be any US Citizen or Resident who qualifies

Thank you for your reply,

You mean that my wife (the petitioner) MUST file an i864 form for me, and my relative should file an i864a form as a joint sponsor?

Yes. This is correct.  Your wife will also be under obligation to be up to date on her US tax requirements and show she has maintained US domicile. What has she done to show this?

But she has no tax files as she is not working and lives with me abroad. hence she has a domicile problem too.

What should we do then? can a joint sponsor solve the problem?

Has your wife kept a US bank account, voted from overseas?

i1864a is for household members with the main sponsor(your wife) but if you are using a sponsor that isn't in the same household then they need to fill out i864 and so does your wife
