  1. My husband had his visa interview in Barbados on January 15. On the checklist it says we need 2018 taxes or IRS transcripts. 2018 tax was the first thing available so I put that in the package for them to review at the interview. At the end they now said I need IRS transcripts. I felt frustrated because it said either or on the checklist. Nonetheless, I sent over my IRS transcripts the very next day and their response was: "The next step is that the consular officer will review the entire case and make a determination. We will communicate with the applicant once we have further instructions. We cannot say whether or not the visa will be ready within your time frame. Considering that the embassy will be closed Monday and Tuesday, processing will be delayed. Then there is the factor of getting the passport to us and getting it back to the applicant". I don't Understand why the entire case needs to be reviewed if that's the point of the interview and if we was only missing one paper why is it taking over a month to reviewed. I honestly didn't think I would be waiting so long after the interview.. I was so excited to get the interview date because I told my self the end is finally near. I also email again on January 30th and their response was "Once the consular officer reviews the case, we will provide an update". I don't know what to do at this point, and waiting is just so frustrating.
  2. Hi everyone! I’m a Green Card holder and my husband and I got married 2 years ago. He is brazilian and we are going through his immigration petition, which already was approved by USCIS and by now we are waiting for NVC mail with the next step (DS-260 form and the financial/affidavit of support form). In this step, we will have to provide a copy of his Biographic Data Page of his valid Passport. My question is: when we got married, one of my husband's last name changed its position (i.e.: Antony Santoro Silva turned into Antony Silva Santoro). Just like that. Will he have to issue in Brazil a new passport, with his new name (married name)? If he does so, he will have to change his current US Visa, which has his maiden name (he gonna receive a new Visa with his married name anyway when his immigration petition gets done). And that seems to be a lot of work and time as he will have to issue a new Visa, Green Card, SS, Driver License with his married name anyway when his immigration petition gets done. In a nutshell: Is it ok to file the DS-260 with his married name but still having his brazilian passport and US Visa with his maiden name? Thank you so much in advance, for your time!
  3. Hi, I am adjusting status from student visa to green card through marriage. My husband is my sponsor but his income falls below the poverty guidelines by $400 so we are using assets (bank checking accounts). We have 2 joint checking accounts so my question is: since it's a JOINT account with both our names on it, should we put it on I-864 as MY assets or HIS? Also, under Current Annual Income, for his expected income for this year, should he put his taxable income or both the taxable and non taxable ? He is self-employed and on 1099. We are also using a letter from his "employer", since he is self employed and on 1099 what should be the wording on the employer letter? Thank you so very much for your help!
  4. Hi everyone! I am starting to put together my husbands I-751 removal of conditions to obtain his 10 year greencard. One of the issues I’m running into is showing proof that we reside at the same residence. We currently live with my mother so lease is under her name. What are some expamples of evidences I could provide to show that my husband and I live together? Also my husband and I don’t share bank accounts I don’t currently have a bank account but I am an authorized user on his credit cards. What are other examples of comingling of finances that I could provide ? Thank you!!
  5. Hello VJers, This is actually very off topic, but I don't know where else to go. My husband is an avid redditor so that forum is not an option... I immigrated on a K1 Visa two years ago, I am sending in my ROC paperwork in May. Life has been very good for my husband and I, we both have good jobs, in August we bought a house and a new car, we have four cats and we are talking about babies in the very distant (like 5 yrs) future. I love life here and I absolutely adore my husband, but there is a big issue and I am struggling to figure out what to do about it... My husband and I took a road trip to my Canadian hometown to visit my family (about an 11 hour drive) this past July. We had a great trip, I saw a ton of my family, we all had a good time swimming, eating, and drinking. BUT on our last night there, my husband and I got in an argument (they happen!), it wasn't an extremely bad one and after fighting for about 15 minutes he wanted to leave the house to cool off, which he usually does when we argue. My Mom saw that I was upset and got involved in the argument, she was screaming at my husband and physically tried to stop him from leaving the house, which included putting her hands around his throat (according to my husband). While everyone was screaming, my Dad panicked and called the police. My husband left the house before they arrived, he went for a walk and ended up at my Aunt's house. The police arrived and questioned me at my parents, then went to speak with him. They made a note about us getting in a domestic dispute, there were no charges against anyone. We were told to spend the night apart and not communicate, in the morning I was to pack the truck, pick him up, and we would head home. We did text a bit during the evening, mainly me apologizing multiple times and him saying he just wanted to leave me in Canada. I picked him up first thing in the morning and we headed home, we argued for the first hour or so and then talked it out. Fast forward to today: my husband and I are still great, our relationship is good and we love each other more than anything. My parents are planning a trip to visit soon to see our new house and bring some of my furniture, and my husband plans to leave the house and not see them at all while they are here. My husband feels betrayed, heartbroken, and has lost his trust in my parents. He saw them as his own parents because he never had strong parental figures in his life. He loved them and is so beyond hurt. We have had altercations in my family's house before (between my parents, with neighbours, etc) which have been much worse and never did my Mom lay a hand on anyone nor were the police called. My husband feels like my parents true colours came out and that they have always hated him, mainly because he took me away. I feel stuck, I want to support my husband in any way possible but it hurts to have to sever ties with my family more than I already have. I miss my hometown, I don't want our children to miss out on seeing where I grew up and having their Aunt, Grandparents, and the rest of my Canadian family. In addition, my Mom's health is poor and I worry that something will happen to her. I don't know how to continue to make my husband feel supported and like I am on his side, while also trying mend the relationship between them enough that we can at least be apart of my family still. I am hoping that someone here has any type of advice to help me through this. Thank you for reading the long post, and thank you in advance for any replies. Sydney
