How to defend wife vawa false accusation to maintain my green card ?

My ex can only submitted I-360 half year ago , no concurrent filing.

If I naturalize now, my ex would get more privilege in her enclosed vawa self-petition immigration, such as filing I-485 while I-360 pending.

She's your ex wife.  She's not going to get any "more privilege" by you becoming a citizen (if you wished to become one).

I am sorry but that's very petty. You should not care about that. You should care about YOUR status, not hers. I understand that her VAWA filing is without merit & it annoys you, but it won't affect your life. You really should move on.

Working together, we can keep these scheming, lying, manipulative scammers from getting away with immigration fraud. Don't listen to those who say you just forget about it and not be vindictive; make every personal sacrifice that is necessary to punish those who have made false VAWA accusations. I know it's hard for someone who hasn't been subjected to a malicious attempt to destroy her life and reputation by means of a spurious VAWA accusation to understand the righteous indignation that would inspire someone to go to such extremes, but try to look at it from the OP's perspective. The sense of shocking, devastating, and uncalled-for betrayal creates a strengthened sense of determination to do something about it, which is not to be lamented, because that is how great wrongs in this world get righted.

The VAWA claim itself won't affect OP's life at all. It's not a criminal conviction even if the ex gets her petition approved.

Agreed - the accused doesn’t have any say in a VAWA claim. The claimed victim has to show their case.

I understand the sense of determination to "do something about it"---a false claim of DV is not easy for the spouse to hear about it, IF they ever hear about it.

 

The fact is, however, USCIS/immigration-wise, there is nothing the accused spouse can do about it.  There's no way to fight it, or even argue/contest it, because it's not like it's a case that goes to trial or USCIS contacts the accused and wants to hear the other side of the story.  All they care about is whether the accuser can present corroborating documents towards their VAWA claim, and whether it's enough to gain an approval.

 

It does not "destroy their life and reputation" in any way, unless actual criminal charges have been brought against the accused. 

Doesn't sound like this is the case for the OP.

This is all true. The only thing the OP can do is not become a citizen because as he or she posted VAWA to AOS is processed slightly differently for abuse victims of LPRs vs USCs. And yes, you can get the spouse of a USC benefits if divorced or separated when LPR becomes a USC. The benefits include being able to obtain a work permit immediately when filing (well we know how long that takes!) vs having to wait until 360 is approved (12 months apx but then you get it very quickly). Also a spouse of an LPR can naturalize at 3yrs.

 

So the OP is doing the only thing he can to 'impact' her living conditions. Since she is unable to work she is most likely using public assistance (VAWA applicants are able to do so w/o penalty) which means his being spiteful results in the US TAXPAYERS supporting his ex. As US taxpayers we are all affected.

Thanks for all. Like I said, she hit me multiple times with wound and witness and police report (but I filed too too late), and I got a TRO protecting me because she harassed me at my workplace and threatened me to harm my life by her hometown tricky lover. She violated import/export law, she owns a company before we met, never filed TAX, as she only receive cash, digital wallet app, and even she receive full spouse support. She continues to work without permit as when I met her, but simply lie, deny, ignore,game, frame, and disguise everything. After bifurcation , she continues abusing my identity to gain her benefit without notifying me.  All these will not be known or cared by Vermont. My personality is simple, just try to buy her out, but seems really really hard.
