Passport Photos for CR1 Visa

I am a US citizen by birth applying for the CR1 visa for my wife in India. When filling out the I130 and I130A, passport photos are needed for both. Since my wife is in India, is a US style passport photo required? Can it be a India passport photo?

I-130/I-130A instructions (https://www.uscis.gov/sites/default/files/files/form/i-130instr.pdf😞

"You must submit two identical color passport-style photographs of yourself and your spouse (if he or she is in the United States) taken within 30 days of filing this petition"

1/2/18: EAD + AP approved (no website update), 1/5/18: EAD + AP mailed, 1/8/18: EAD + AP approval notice hardcopies received, 1/10/18: EAD + AP received

9/5/18: Interview scheduled notice, 10/17/18: Interview

10/24/18: Green card produced notice, 10/25/18: Formal approval, 10/31/18: Green card received

7/13/2017: Interview: APPROVED!!!

Ok, so not needed if she is not in the USA. I do recall reading that but wanted to confirm. Thank you.

Just let your wife gets that passport photo style in image file then send it to you by email or messenger...etc. you take it to photo printing shop and tell them to print out as passport photo style for you. make sure you write full name and date of birth at the back each photos. my wife did this.

But if it is not required (since she is not in the USA) why bother to do this? Won't it just create confusion? As they will believe she is in the USA when in reality the photo was taken in India and printed in the States. Just looking for clarification.

It won't hurt, but it won't help either. They'll just ignore it since it's not required.

this is the fastest way, but you still can let her takes, prints and sends it to you via any kind of mail. its your choice but USCIS's requirement(photo both petitioner and beneficiary)for that. best of luck.

Right.  Passport style photos of the beneficiary (foreign spouse in this case) are NOT required with the I-130 anymore.  They used to be, but not now.

 

She WILL however need several US Passport Style photos for the medical and the interview.  4 will do nicely.

I'm glad I read this I really overlooked that part, but my wife had mailed me her photos anyways. I'm wondering if I should submit them just in case
