What if I'm Disabled and don't file Income Tax

MY Immigration question

 

 I understand if I'm Disabled I can be married (keep Medicare) but what about the IRS Returns required?   (I was disabled at 38 years old and worked enough Quarters to qualify for Disability Benefits.  At 65 this turned into Social Security Retirement, this cannot be denied then correct?)  I receive $1,244 a month or $14,928   The Poverty Line is $16,460 for the K1  and $20,575 for Adjustment.   So for the K1 I would need a Sponsor that  hands over $1,532 a year (or $127.66 a month /$32 a week) and later 125% .

 

The question (besides the IRS Returns requirement which logically must be waived) is:       Can my HUD be counted as income because it practically pays my rent?  And if not and I can’t find a sponsor – has anyone heard of Americans With Disability Act, etc.  that allows for a severely disabled person the right to have a wife help take care of him?  (I use a Motorized Wheelchair and have a HHA /Home Help Aide)

First HUD is not income so I doubt they will even look at it.

 

And second thats not how sponsorship works they need to have income that covers their household size plus your fiance.

your co sponsor has to meet the entire amount - not the difference.

 

HUD is not considered income. Even if your rent is paid for you, how will you be supporting your fiance/new spouse on that little a month? They can not work for quite some time. The EAD can take 6+ months to get right now.  The ADA will not come into play at all for this. You can hire, or have medicare pay for if you qualify, for home care. K1s are for marrying the person you love not for marrying a live in caretaker. (im not saying this is how you view it but it IS how USCIS will view it)

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

It is certainly doable but you will need a cosponsor.

I may be wrong but last I checked, EVERYBODY has to file an ITR.  I have a friend on disability and he files every year.  He never has to pay or get a refund but he does file.  I'm no expert and a waiver for his situation seems logical.  I will ask him.

 

Your co-sponsor would be responsible for the entire amount, not just the difference.

PHILIPPINES ONLY!!!  CFO (Commission on Filipinos Overseas) INFO - Can't leave home without it!

 

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.
