Hello all,

 

we applied for IR1/CR1 visa and we have been on administrative processing for 20 months without given reason or update since the interview when no papers or additional info was required from us.

so we are thinking about takin some legal action at least to know what is going on and where we are standing and shake things a little bit.

so please tell us what you think and recommend good immigration lawyers that handle similar cases successfully.

Contact your senator/congress person.... a lawyer has no legal standing technically with the embassy. He could request a FOIA perhaps about the case but if it's under AP that probably isn't even possible. Even if it was that can take awhile to even get any info at all. So probably just be a waste of money.

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

Writ of Mandamus would be the thing you would be looking for.

We have already contacted the congressman man, he only inquired on our behalf and they give him just the same response, can he do more?

The lawyer is a must if we are going to litigate themor at least threaten it for some deal, also they usually have connections to get more info about where the case is stuck

or at least I hope so, I think you kinda understand how we feel

Oh I couldn't even begin to understand the frustration of that type of waiting without info. So I won't even attempt to say I do. @Boiler gave the good answer, I'm a bit off today for some reason but that's what you're looking for.

I have seen Lawyers mentioned but do not remember the names.

i bet they will be frustrated with us :)

There is nothing lawyers can do for you Administrative processing take some times between 2 years to 3 years some case take shorts cos its depend on case they are doing there job at embassy so just email them each times and they will replay back to you there is nobody cant do nothing for you until Administrative process complete at embassy .Plus I have been Administrative process from 2011 to 2014 more them 35 month my case was stuck at embassy after they issued my visa so no worried just be patient they will issued your Visa email keep checking updates online hope this information can help you .
