How difficult for company to sponsor?

To be clear, there is no company immigration lawyer.  This is a teeny tiny business.  My husband started this LLC 2 years ago with a partner.  I have an MBA and am reasonably capable of running the books and managing the scheduling and whatnot.  The partner decided to pursue a second degree and leave the business.  My husband is an operations manager in a distribution environment and used to work long shifts, which meant fewer total working days and an ability to schedule jobs on his "days off."  Now, he's moved up the ladder and will be working closer to "normal hours," which means less of the work for his company will be done himself and he will have to rely more on his workers.  We are trying to convince the worker who moved out of state to move back, and he is considering it.

 

Yes, the drug test is a problem, but non-negotiable.

I see too many people from certain parts of the world who will only hire their countrymen or religious background.

 

Women now work in construction jobs. Do you unconsciously discriminate based on gender?

 

I cannot believe your DH's employer approves of him running a business on company time. Maybe this needs to be YOUR business.

 

Hire an attorney. You need to check whether you can legally refuse to hire people with criminal records.  Many have been rehabilitated and just need a second chance. Check with your state department of rehabilitation?  Many disabled people are capable of working when supervised.

 

You have a lot of excuses.  Where do you plan to get these employees?  Family? Friends from your home country?

Well you have to work within your means, Work Visa's are not setup for teeny tiny companies, they are not banned from applying for one but obviously larger companies with standing and resources have more opportunities.

 

I am reasonably familiar with Immigration, would feel confident in getting say J1's in as a diy. However in your situation definitely get a Lawyer involved, that is what most Immigration Lawyers do, work related stuff. And for a reason.

 

Whether from a Business perspective the time and investment is worth it, well seems you are more than competent to do the numbers.

He does not run a business on company time. How in the hell can he be managing 40 employees in a distribution center and at the same time installing hardwood? What the hell are you talking about?  If a woman wants to apply, has her own transportation, passes a background check and doesn’t use drugs, send her our way!  Both me and my teenage daughter have most certainly worked with the crew multiple times.  Please shut the hell up. Seriously.

Boiler,

Do you think a J1 visa for people who want to learn the trade is a viable option?  If we can convince our already trained and trusted employee to return to our state, That situation could work.

It’s also again VJ rules to tell me that we want to discriminate based on nationality or gender and harass me and not answer my questions, as posted. This person is also telling me my husband is running a company on another company’s time, which is utter bullshit and, again, has nothing to do with my question. I didn’t ask for an opinion on hiring foreign workers. I asked for an answer to a question, which this person is not answering.

1.  I am not trying to get H1B workers. 

2. My home country is the US of A by birth. 

3. Females can apply. 

4. We don’t specify religious qualifications on our ads and don’t ask a person’s religion. 

5. My husband needed to pass an extensive background and drug test for his management job. He would have been denied the job with even a misdemeanor, but he has nothing on his record. We will not allow a criminal to enter our client’s homes. There are background checks for employment for a reason. You are talking out of your ###. 

 

Qualifications:

1. Work hard and be trainable. 

2. Pass a background check

3. Pass a drug test. 

4. Have your own transportation to job sites. 

 

Also, we pay a livable hourly wage, which is DOUBLE minimum wage. And, my husband buys lunch for his crew every single day they are working. Unfortunately, most who apply fail at least one of these qualifications. We have an amazing worker now but he will be off to college soon. 

 

Get off my back.

I have family in the Business so I have some idea, if they asked me a J1 would not be obvious.

 

I have friends who employ J1 for the summer, also happens in the ski business for peak winter, I thought you wanted someone longer term?

 

One of the reasons this is a LAwyer issue, so many variables.

We would like someone(s) longer term, but as you’ve likely surmised, we are struggling to find that. If we could have at least one long term person, we could conceivably rotate out the other crew every few months without too much trouble. 

 

I’m going to contact a few lawyers tomorrow and see what I can learn.   Thank you for actually attempting to answer my questions.

I’ll see what I can find out. If this isn’t a diy project, I’ll focus instead on finding the best attorney for the situation. I’ve already submitted the prevailing wage thing online, so at least that step is in progress and I’ll see what the attorney can do from there. 

 

To the other person who thinks we are hiring only “countrymen,” I guess you are correct. Andrew is the former business partner. Mikey moved out of state. Nick is going off to college. My name is Gina, my daughter’s name is Autumn and my son, Atticus,  has also helped. Of those, I know Atticus sounds exotic, but I assure you he’s just your average American 20 year old white guy. 🙄

A number of posters have told you the correct answer, but it’s just not one you want to hear: work visas are not DIY. You don’t necessarily need to hire your own full time lawyer to handle the visas you want, but you need to hire someone to ensure you are fully legally compliant in both the hiring and the visa process.

..and there are very few posts on VJ to which the response is “hire a lawyer”, so when that is given as a response by not just one but most posters answering your thread, it is not meant flippantly.
