I am saying she is not responsible because she never signed the I-864. They never filed for AOS.

well he is the dumb one who left because he listened to someone who told him wrong. From what she said to me he has been out of status since march and now his visa is expired. he failed himself she did a k1 visa to be with a person who she thought loved her

the I-864 was signed in the process of K1 Visa that is with  every k1 or k3 Visa

K-1 visa uses the I-134, which is not enforceable.

An I-864 still wouldn't matter unless AOS was approved.

I-864 is NOT signed in the process of getting a K1 visa. I-134 is signed, which is not enforceable.

She is not. As you can see from multiple comments, the I-134 is not enforceable.

 

And just to clarify one more time even if I-864 was signed (it wasn't), it only counts if the intending immigrant is approved for a GC. That never happened in OP's situation.

that is  up to them what they will do hoping for the best for them both but this is one hella of experience for her well all of us because we all got fooled

i hear you but no where i my question was is stated she will be doing that. i just asked for an opinion but i noticed everyone jump down on her for moving on in 5 months w/out knowing the whole situation. Opinions is just that so whatever she decide it is her life

Hi, tell her give another K1 application a shot. The process will be long anyway (++200 days only for noa2 approval) and during that time let her decide if her boyfriend is good enough- people change over waiting time and I do believe your friend will know because she experienced it.

Her petition being failed or not is not everyone in this site’s decision. As long as your friend and her boyfriend eligible to apply just do it.

This is irrelevant but compared to my country’s immigration laws, US immigration laws is more logical and neat. Don’t lose hope.
