Also, my Congressman's office contacted me and will present my case to USCIS and NVC.  I do not anticipate anything happening but if they do, on a very rare off chance, allow an RFE I will have even more to think about.  My Congressman's immigration liaison though that it is worth a chance at getting it reopened.  I highly doubt that they would do that but at least, for the first time in a week, it isn't all bad news.

PDOS (Pre-Departure Registration and Orientation Seminar) is for ages 20-59.  Peer Counseling is for 13-19 years of age.

It is required to have the visa in their passport for PDOS and Peer Counseling.

 

GCP (Guidance and Counseling Program) is for K-1 Fiancee and IR/CR-1 spouse ONLY.

On that note I will mention that I do remember a case where the petitioner was asked to submit a new I-129F to USEM as the petitioner had made an error when completing the form .. details? .. sorry don't remember, just remember USEM doing that.

This is kind of a weird error.  It was plain and simple my fault and I didn't pay attention to the directions.  I would hope that they may look at it but this is all on me.  I hope someone is in a good mood and looks at the whole petition.  There is no one to blame but myself and I hate what it is doing to Rose, Aira and AJ.

So for the OP he hasn't yet done most of the paperwork since the visa wasn't granted and AOS didnt happen.  Thankfully with the CR1 it happens before entry!

AOS process is the same for K-1 and CR-1 , both require the I-864 and supporting evidence  (NVC does ask for a variety of additional documents during the process there for the IR/CR-1).

 

Not sure what your point is, nothing is avoided with the IR/CR-1, the order of processing may be different but nothing is avoided.   Plus the processing at NVC adds how much time with the IR/CR-1 before the case file is forwarded to the embassy?

 

You made a wrong statement regarding  AOS ... just don't want to step-up on it.

Aos as in adjustment of status not affidavit of support.  Same acronym, different meaning.  Lol. I see where you mistook what I said.

 By any other name a ROSE is but a ROSE..... THE SAME PROCESS     ..... I-485 is the only difference.   Required of both is the I-864 and supporting income evidence, along with copy of marriage certificate.

 

I don't care what name you call it ... they both refer to the same process, just at different points in the process.    YES ... NO?

 

Your original statement is still wrong/misleading.   NOTHING is avoided

The OP did not complete the K1 process because his wife was not granted the k1 Visa so she did not come to the USA and did not adjust status.  So for his fiancee, she did not complete the process to green card.  

 

No I dont agree.. one is adjustment of status and the other is affidavit of support.  They are two different things.  

 

Last post on this subject.  The OP did not complete the process of I-129F to green card.  So because the K1 Visa was not granted, in his PERSONAL case he has not completed the process.  My comment was made for HIS PERSONAL experience. 

In GENERAL the process is approximately the same.  However more money, time, and paperwork is needed for the I-129F beneficiary to gain a green card than a CR1.  That has long been a benefit of the CR1 visa.  Its longer to visa but less money and paperwork.

Actually John's initial post was specific to the Philippines ... as he was talking of the interview and denial at U.S embassy Manila.   And then further talked of needing an AKA from NBI (a Philippine government agency).

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Good job John! glad you contacted your congressmen. My lawyer said when a congressmen is contacted and then they contact the embassy , the embassy officials know that someone in congress is watching this case. Email from my congressman from last night said they contacted the consulate and waiting for a reply.

August 4 2017 - I-129F Sent to USCIS

August 7 2017 I-129F Delivered

August 9 2017 NOA1 Sent out

August 14 2017 - Received email from Lawyer NOA1 received

August 28 2017 - Returned to USA/NOA1 was in the mail waiting for me delivered on August 14th according to my brother who collected my mail

September 7 2017 - 1 month into waiting for NOA2

October 7 2017 - 2 months into waiting for NOA2

November 7th 2017 - 3 months into waiting for NOA2

December 7th 2017 - 4 months into waiting for NOA2

January 7th 2018 - 5 months into waiting for NOA2

February 7th 2018 - 6 months into waiting for NOA2

February 17th 2018 - NOA2 - APPROVED!! noa1-noa2 194 days

January 10 2019 - Passport received by embassy.....case update as well

January 11 2019 - CEAC page shows visa status ISSUED!

January 14 2019 - Visa received.

January 15 2019 - POE - Dallas Ft Worth - Arrived Mobile Al airport - now home with me.

In my case I am 100% at fault so I don't anticipate anything but I had to try.

It's certainly better than nothing at this point in time and hopefully everything works out for y'all without having to do a CR-1. This is something that should have been caught long before it hit the embassy and at least you should have got a RFE but not a outright denial.
