Please READ and tell me my options anyone

hi everyone 

 

 thank you for reading and i hope someone could give me some clarification on what is going on with my case.

 i entered the us in march 09 through fiancee visa ... got married to the same person within 90 days and i applied for my green card

i received my conditional green card in january 2010 and in 2012 i applied to remove conditions and was given a receipt number EAC****1337

in 2013 i went for bio-metrics and all good, later i received a letter to appear for an interview .... one week before the interview date i received another later that stated:

" due to some unforeseen circumstances we had to reschedule your interview and we will advise you on time and date by mail...

i never received such letter ( and kept calling uscis to see whats going on and was told that on their end everything was normal and i just have to wait for the letter.

in 2015 i got divorced and moved out to another state and notified uscis of my new address. during the move i lost my wallet and my green card ( therefor i had to go to the local immigration office to get a green card stamp on my passport once a year on the 5th of march) 

in 2015 i received a letter from the uscis saying " after careful review of your request ( i called them prior to change my address ) its had been determined that your issues will be best addressed by a uscis office ... we have taken the liberty to forward your service request to california service center." THE RECEIPT NUMBER ON THE LETTER WAS DIFFERENT FROM THE ONE I HAD. EAC****0515

later on i called to check my status, the officer told me that its still within processing time and i should wait to hear something soon ( never did )

in march 5th 2016 i went to get a stamp like normal at my local immigration office and the officer told there gave me a stamp and told me that i had a hearing on march 10th in orlando ( where my immigration case is ) 

in march 16 2016 ( six days after my first hearing ) i received another letter from uscis with that my application has been denied. so i called the uscis again and was told that they dont know whats going on and i should wait for my interview because my case is still pending and processing and everything looks normal. NOW THIS LETTER HAS MY VERY ORIGINAL RECEIPT NUMBER EAC***1337

i made it to the hearing ( march 10 2016) to find out that i have missed the interview in 2014 that i never received a letter for or anything ( they cancelled the first one and was waiting for a letter with a new time and date for the interview ) 

i had 2 more hearing after that and i missed one of them which automatically put my in removal and deportation on feb 15th 2017. ( cant justify why i missed the hearing nor was i in federal custody ...)

now this is the tricky part. 

i went back yesterday to close my online account at the uscis website and for the heck of it i typed it my case receipt. and i quote what it said

" on april 10th 2018 we received your form i751. petition to remove conditions on residence, receipt number EAC****0515, at your local office"

i called uscis and an officer confirmed to me that they just received my i751 on April 2018 ( i didn't send that as i was placed in removal on the 15th of February 2017)

then i asked to check another recipt for me which was the one i originally had EAC***1337 and he says that its still in processing and that he cant see any interviews or removals or anything as if someone just applied to remove conditions. 

I AM COMPLETELY LOST AND HAVE NO IDEA WHATS GOING ON OR WHAT TO DO. 

please advise me on what to do.

do i qualify for cancellation of removal 42-A since i ve spent 7 years as a legal permanent resident 2 of which were condiontional

I think you need a good lawyer, this doesn't sound very straight-forward.

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

I would start by making an infopass appointment, bringing all those letters you have received, copies of you application, etc and demand to speak with a supervisor if the officer cannot figure it out..

Live, love, laugh.. and try not to think too much about USCIS

Get a lawyer and settle this in court. They will have to make a solid decision In court. But a court date can take a while !
