Me and my (spouse and two kids) immigrated to the United States from Bangladesh in 2010 with a green card. He had to go back to take care of a few things back home and stayed out of the U.S for over a year. As a result, he lost his permanent residency status. We have been married this entire time and were in contact and went to visit him once. Now he is ready to come back here and reunite with us. Do I petition a new immigration application for him under spouse category (I-130) or is there a quicker but guaranteed way for him to come back here? Thanks in advance

No you have to petition for him all over again just like it's a new petition. Are you a USC or GC holder? If your a USC the process is about a year, and if your a GC holder it's 2 years.

Why was he gone so long?

 

Are you are aware of the I 864 requirements and can meet them?

You have to start over with a spousal visa. But we need to know if you are a US citizen or permanent resident.

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

Yes I am a USC, naturalized couple of years ago since I was never out of the country for more than a month for 5 years after getting my GC. Thank you for your input.

He had some land disputes on going and also family emergencies, he wanted to come after a year and half, but decided to take care all of the disputes and then apply.
