I got a hold of the memo and read over it and there is so much in there to explain but it has nothing to do with K-1's. Basically if you are applying for a benefit (visa) and you are not eligible for that benefit or you are not using the benefit for it's intended purpose then the adjudicator doesn't have to send you a RFE or a NOID. Just VOID. Done!

 

But if an application is received with an error or missing documentation then the adjudicator is obligated to complete the entire processing up to and not including the approval, but must combine all RFE's for that case into one request. In the past they may send out a RFE letter then two weeks later send another RFE for a totally different circumstance tied to the original submission. The memo requires them to ask for everything in one letter.

 

So there are many good things in the memo. One just has to take the time to read for themselves and not rely on CNN or Betty Lou over in the Jamaican thread who is afraid that the sky is falling in on her K-1 visa with the intent that she is going to get denied. Believe it or not the spirit of this letter was promulgated in the Obama Administration. This administration is only trying to get the rules so that they are followed. There isn't anything in there that is made up without a reason now or from the past.

We are planning a visit for my fiance to come see me, can someone please provide a short list of the items (paperwork) she should bring just in case she needs them at the airport?

I just took a letter from my employer to say they have authorised my leave and I am expected back to work on xx/xx/xx and my return flight info. I didn't get asked for anything and they didn't even mention it but that was back in April so it may have been to early. 

My fiance and I are going on vacation to Florida right when our NOA2 is expected so I think I will try and take more evidence to show i will be returning such as a letter form my landlord to say i am in a contract, letter from my employer and my return flight info. Others may have better advice :)

Also worth taking a copy of your NOA1 letter that the petitioner (USC) received in the post! I had mine when i visited, wasnt asked to show any proof but handy to have with your other ties :)

Yeah that’s a good shout. I didn’t have ours on my visit in April but I took it with me and I’ll take it with me in September. Thanks!

I was asked the purpose of my visit & i said “visiting my fiancé” & the border patrol officer asked if i was planning on moving here, i said “yes but in the process of my k1 fiancé visa” & he said “okay great” no proof asked but handy just incase then I could prove were doing everything legally, put my mind at rest having it!

That’s good. They know we are visiting our fiancée so saying you’re not they will know you’re lying so I guess just being upfront and honest is the way to go always :) 

 

It would be so cool if we get our NOA2 whilst we are on Vacation in Florida!

Congratulations!!! I am so happy for you!!! That must be such a relief! I can’t wait for that day!! And thank you so much :) I think as we edge closer I will definitely have some questions. I’ve just seen on another thread someone from U.K. got straight up denied after 7 months due to lack of evidence, not sure if they are testing out the new system or she just didn’t have enough even for an RFE. So heartbreaking and made me worry but not much we can do than wait!

It honestly is the BEST feeling!! Its surreal, hasnt sunk in fully yet 😂

 

Dont panic!! No offence to the other UK filer, but from what i read they didnt supply the correct evidence which is mentioned on the K1 guides, i don’t understand how they made that mistake tbh.. everyone knows to triple check these type of applications before you send off!! try not to compare yourself to other peoples cases, every case is different :)

Yeah did you read it? They only submitted a written statement to say they had met within the last 2 years and that was it. We submitted so many photos etc. My other half proper moaned at me last night because I am such a worrier and he is a typical cool New Yorker lol!

Yeah i read alot of the thread - they thought they would be 'front loading' by adding the actual relevant evidence.. i dont know why they thought that.. id be absolutely devastated if we made that mistake :\ 
I was a terrible worrier throughout this process too, my fiancé is laid back & always told me 'its going be okay' well, he was right LOL just couldnt help but worry because it means soo much to be able to finally close the gap & marry him!!

It is going to be strange, i think i will get moments of being home sick but i spent 2 months at Jake's in March-June this year & it was honestly like i was already living there, felt settled :) 
Im taking a huge jar of Marmite with me, we couldnt find it anywhere when i was visiting his LOL - also wish i could clone my dog :(
