Hi everyone. My husband and I are going for the AOS interview this coming April 30. We are now on the process of preparing our documents. We reviewed each document and found out that my husband clicked Married filing separately for the tax return instead of married filing jointly. We are now worried that they might consider it as a red flag. 😣 Should we try to change it before we go for the interview? We only have less than 2 weeks left.

I don't think that's a problem, as long as you filed as married. We filed separately too, simply because I was filing taxes in Spain yet for last year, since that's where my residence was for most of the year. My SSN is on his US tax return and his name is on my Spanish tax return, so I think that's enough.

Good morning guys!! Hope all is well!... congrats for all those who received their paperwork!

 

 So i received an RFE from USCIS related to the I-485, this is better than no news to me, means they are looking at my case. 

 

Now, my questions are these:

 

1) anyone who has received an RFE can you tell me what they have been on (so i can attempt to gather the info before i get the notice)?

2) is it possible to still get the i-765 while waiting for this RFE process?

Hello

1) My RFE was about my birth certificate, they wanted a copy of it (mine is in French), so I sent it back again along with a translation, with a cover letter and a short explanation. That was back in February, I havent heard anything since and still no EAD. You can check my signature for specific dates

2) Unfortunately no you cannot receive the EAD until you send the response to the RFE because it stops the process for all your applications, but seeing your timeline and how late in the process you received it, from what I have seen, you should get your EAD a few weeks after they acknowledge receiving the response to the RFE.

01/08/2018: Priority Date

01/19/2018: Checks cashed

01/22/2018: 3 NOA's received in Mail (I-130, I-485 and I-765)

02/09/201: Received Biometrics Appointment Letter scheduled for 02/22

02/10/2018: Email notification of RFIE :(

02/12/2018: Early walk-in for Biometrics, successful

02/16/2018: RFIE received for birth certificate and translation, sent back the same day

02/20/2018: RFIE response delivered, sent via Fedex

02/23/2018: Case status updated to RFIE response received

03/05/2018: Courtesy letter for I-693, medical exam received, letter dated Feb 28th

03/08/2018: AP application delivered by Fedex

04/16/2019: I-130 petition approved

04/20/2019: approval notice received in the mail

04/22/2019: received notification of RFE for AOS I-485

06/01/2019: RFE finally received after being lost in the mail, asking for a new medical exam

06/06/2019: Response to RFE sent, received the next day 06/07/2019

06/17/2019: Received notification of another RFE, 3rd time will be the charm hopefully

06/22/2019: RFE received for new medical

07/02/2019: Went to doctor for new medical

07/11/2019: I-485 approved without new medical exam

07/18/2019: Green Card received in mail
