Hello there everyone! I’m new here I need some info for my k-1 visa process.i and my fiancé haven’t send the petition form before that we wanted to make sure that my medical is clear and when we did x Ray it’s abnoramal (PBT) what should I do ? I’m already in foreign country and I’m graduating in 2018 sep . If I diagnosed with active tuberculosis and currently on medication can I process my k-1 visa process ?

If you have active (Class A) TB and are currently going through treatment, you are currently ineligible for immigration to the United States.  You'll need to wait until your treatment is completed and then you'll need to go through another medical screening in order to be cleared for immigration.

c.  (U) “CLASS 'A'" Finding for Infectious Tuberculosis:  A visa applicant identified by the panel physician as having Class “A” infectious tuberculosis is ineligible to receive a visa under INA 212(a)(1)(A)(i).

(1)  (U) TB TIs:  A visa applicant identified by the panel physician as having “Class “A”” infectious tuberculosis is ineligible to receive a visa under INA 212(a)(1).  However, in exceptional medical situations, a provision allows applicants undergoing pulmonary tuberculosis treatment to petition for a Class “A” waiver.  Waivers can be pursued for any applicant who has a complicated clinical course and who would benefit from receiving treatment of their TB in the United States.  It should be noted that historically these waivers have rarely been granted due to the infectious nature of the illness.

(2)  (U) Waivers:  You may recommend a waiver of the ground of inadmissibility to DHS/USCIS for IV or DHS/CBP for NIV; provided that the alien has met certain CDC requirements.  (See 9 FAM 302.2-5(D)(1) below for waiver procedures for immigrants or 9 FAM 302.2-5(D)(2) for waiver procedures for nonimmigrants.)

(3)  (U) When Waiver is Not Granted

(a)  (U) Any applicant with Class “A” TB who needs treatment overseas and who is not granted a waiver, is medically ineligible to receive a visa until the completion of successful DOT treatment and have negative sputum smears and cultures at the end of therapy in accordance to the TB TIs.  Consistent with other applicants started on tuberculosis treatment prior to travel, if TB therapy is started for an applicant ten years of age or younger, the applicant should be found to have a Class “A” TB classification by the panel physician.  In this case, a Class “A” waiver can be filed with CDC so that it can be reviewed and the applicant can travel to the United States before completion of therapy.

(b)  (U) For any Class “A” TB case involving a young child, the CDC supports the filing of a waiver application so that they may review and adjudicate in a timely manner.

(4)  (U) Refusal of Treatment:  Do not issue a visa to applicants with positive sputum smears or positive cultures who do not want to be treated. 

(5)  (U) History of Noncompliance:  Do not issue a visa to an applicant with a history of noncompliance until he or she has completed DOT treatment in accordance with the TB TIs.

d. (U) Class “B” Finding for Infectious Tuberculosis:  An alien who is found to have Class “B” medical condition for tuberculosis is not inadmissible under INA 212(a)(1)(A)(i).

If you feel you have active TB and are on meds now, it's usually 6 months of treatment. 

 

Keep in mind how TB is spread, you would not want to get your fiance or their family/friends ill I'm sure so it's best for everyone if it's treated now.

Would advise you to also get further evaluation based on your chest X-ray, especially if your sputum testing result comes back negative.

Before sending  my petition form,I decided to do medical exam in local hospital and it turns out that I have old tuberculosis densities and left upper lobe emphysema then they asked me to do skin test and sputum test(sputum test was negative x2)and skin test was positive for first time and second time it was negative. What should I do when I go to the embassy hospital for medical?should I take my these x-ray,cat scan and sputum results with me and how long it can delay my procedure?please help me

My fiance tested positive on the chest x-ray during his medical last month. He had positive TB many years back when he was a kid that was fully treated, but I guess it will always show up on an x-ray? He was sent for sputum testing which takes 8 weeks for processing (in India at least, not sure if the times are country specific or not). We are about 3 weeks away from when the final results are scheduled to be in then we can proceed with the embassy interview.

 

Even with him telling them about the past instance here he was fully treated, they still required the sputum testing. So I would definitely recommend bringing any and all records/paperwork you have regarding the test results, but chances are they will still require the sputum testing no matter what.

We got our NOA2 in about 4 months. Filed in March and received NOA2 in late July. As long as the sputum is negative then we should be fine to proceed and get the visa issued so long as the approval is granted at the interview. If the sputum is positive then treatment for TB is required which is 6+ months before the visa process can be continued.

what if the petitioner and the beneficiary both live outside the United States but are planning to move back. Does the petitioner need to fill out an affidavit of support along with the sponsor ? Or can the petitioner just submit one affidavit of support from the sponsor ? What if the petitioner has no funds within the US and will be relying on the sponsor upon arrival ?
