Hello! :)

 

My fiance is Cuban and arrived to the US on a K1 visa in early September. We got married last week and are applying for Adjustment of Status. I wanted to make this forum for anyone going through the same process, previously, currently, or in the future, in order to share helpful information and advice.

 

Questions

Does anyone have a checklist of documents/information they submitted along with their AoS, SS, and EAD applications? Are all documents, including marriage certificates, meant to be submitted in copy form? 

 

As K1 visa applicants that were approved, do we have to submit as much evidence about our relationship as we did for the I-129F and visa interview? Does this include photos, messages, call logs, shared bank accts, etc?

 

Finally, since our fiance's completed their medical in Cuba or wherever their home country is, do they need to do this again in the US? If not, what paperwork from their initial medical exam do they need to submit?

The evidence will not be a part of initial AOS submission, but WILL be a part of your AOS interview.  So you'll have time to gather that evidence.

 

If the K1 medical was done under a year ago, you do not need another medical in the USA.  Just need to submit your DS-3025 form, the vaccinations form you should of gotten back from doctor in Cuba.  If it has been over a year since your medical in Cuba, then yes, you'll need another medical.

Some other questions as I am filling out Form I-485.

  @058rocale  @forena99 @eruiz3 if you guys went through any of these I would be so appreciative for your help, like always! :) (L)

 

Questions 23.c. Status on I-94

My husband's I-94 says "Class of Admission: K1", am I supposed to enter that? The form doesn't let me enter numbers or special characters only letters, so would I have to handwrite "K1"?


24. What is your current immigration status? (If it has changed since arrival.)

Do we fill this out? If so, what do we enter? He came on a K1, we married, and now are doing AoS.


Part 2. 2. Are you applying for adjustment based on the Immigration and Nationality Act INA section 245i?

Assuming thats a No, for K1 Visa?


Part 3: 1. Have you ever applied for an immigrant visa to obtain permanent resident status at a US Embassy or Consulate Abroad?

Does our K1 visa application count? Or do I answer no?


Part 3: Did you write the addresses of old residences and employer in Spanish or English, how they would appear in Cuba or us?


For residences and employment there are two sections - the first two questions ask for most recent, then the next two ask for most recent residences/employment out of US, should we just follow in chronological order? For instance, my husbands current address is in New York, US, and his previous was in Havana, Cuba. Do these need to be listed in the separate sections, or consecutively?

Part 8:  1. Have you ever been a member of, involved in, or in any way associated with any organization, association, fund, foundation, party,  club, society, or similar group in the US or any other location in the world including any military service?

My husband spent 9 months doing the obligatory Cuban military service, in a general position. Would we have to mark YES for this question? And it has implications for the following questions:

 

49. Have you EVER received any type of military, paramilitary, or weapons training?

We are hesitant to answer yes because he truly did the most basic form of general military service. Thoughts?

 

55. Have you EVER served in, been a member of, assisted, or participated in any military unit, paramilitary unit, police unit, self defense unit...etc?

Would we answer yes to this since he was technically in the military?

 

Thank you for reading through this! Obsessing over the details a bit as we want everything to be correct. Any help would be so appreciated!

I do not believe that you're vaccination form itself will need to be translated.  This is what your DS-3025 is for.  This document should have your vaccination record and whether your vaccinations are up to date or not.  If not you will have to fill out the I-693 with the vaccination record section filled out by a USCIS-approved Civil Surgeon (which will be in English).

Let me clear something up so I can hopefully inform you better @TatiyPablo.  If your vaccination record is not up to date then you may have to have your vaccination record translated.  Here's what I did.  I have a K2 who needed to have vaccinations.  We took him to the county health department and they had employees that are bilingual (Spanish/English).  They read his vaccination record from Colombia and transferred all the information (as well the vaccinations he had for his appointment) to a card that was from the county health department, and therefore we did not have to have his vaccination records translated.  We're going to do the same thing for the K1.

So our issue is that my fiance never received a  DS-3025, when he did his medical in Cuba the doctor just filled out the Cuban forms required for an embassy interview.  Right now all we have is his receipts and the vaccination card. The doctor in the home country is supposed give you the  DS-3025  form, no? We didn't know about it which is why we are trying to sort this now. 


Since we don't have one, I am thinking he will have to go to a doctor here to complete the I 693?

Yes, the Cuban Doctor. If it's not possible your other option is to send in your application without the i693. His medical contains the original DS-3025, and many people are approved without sending a copy of it. You could just mention that "DS-3025 included with overseas medical in A-file (vaccinations requirements complete)" If you know that he completed everything. If they do not find the DS-3025 they will send you an rfe. The last option is to get the i693 and try to find a CS who will transcribe his vaccinations without asking you to pay for a whole new medical (which many do).

I understand, I didn't even think about that. I suppose I am somewhat spoiled in being from a country where most things are handled electronically. Be aware, the CS's will most likely try to convince you to pay for a full medical and that they "can't" just do the vaccinations portion. Which is NOT true, so stand your ground and/or keep looking :) Maybe you can find someone on VJ in your area who has a CS recommendation.

It's a No - K1 is non-immigrant with immigrant intent

Consecutively and in separate sections. Sometimes people have moved and worked in several places in the US before applying for AOS.

To all of the above, if the answer is yes, then it is yes. You can clarify and write "9 months mandatory basic training" or similar
