My spouse is in immediate danger in his home country. We have had no luck in getting our expedite request approved. What can I do to make this process go faster or to bring my spouse to the USA immediately? His relatives in his home country tell him that someone in the USA can "make a call" for him to go there on a visit. But I don't understand what this is or I would have done it. One of my brother's coworkers that went through the same process told him that there is a "Sponsorship visa" or "Invitation visa" that he can use to visit temporarily while this process goes on. But I find no information on any of these options. Is there something I or my family can do to help him come to USA immediately even as a temporary visitor or to speed up this process? What are these visas that people are telling me about? Please HELP US

What country is this?

 

These relatives are probably referring to a letter of invitation for a tourist or visitor however it is rare for a tourist visa to be granted to a beneficiary with a pending immigrant petition who is married to a USC.  

 

It is also illegal to obtain a tourist visa and use it with intent to enter the US for immigration.  This is neither recommended nor advised as it puts your husband at risk to be sent right back.

 

There is nowhere to "make a call" to skip immigration requirements.  You appear to have done all that you can do by requesting that the petition be expedited.

First things first... there is nothing that is immediate with immigration. Even if you were approved for expedite, it will still take weeks.

 

Also, someone "making a call" so he can get a visa is 100% false!

 

Lastly, those sponsorship or invitation visas are wrong also.

 

Listen, you are hearing a lot of rumors from people in a country other than the US talking about US processes and policies. They are on the outside looking in just like you are. Every bit of information you have received is inaccurate.

 

If your spouse is in extreme immediate danger the best thing to do is help him remove himself from the danger. If he can travel to another city or another country that doesn't require him to have a visa then have him do so. The difficult truth is there are millions of people that are in danger every day in some form. The US do not give out immediate visa like you mentioned. The US DOES help with extreme circumstances like refugees from war stricken areas. But at a personal level you should learn about submitting you proper documents for him and helping him to be safe. The best way to move forward is to file for a spousal visa and ensure everything is error-less  to reduce RFEs and to prepare to submit evidence on why his case should be expedited.

Probably talking about a Visitor Visa to allow him to visit during the process, nothing for you to do, he would be the one to apply.

you found no information on these options because they do not exist.  

 

no one make a call for him to get a visit.  he want visit he apply for visitor visa.  only way.  

 

no sponsorwhip visa or invitation visa.  do not exist.  maybe invitation letter but us embassy do not care.

 

nothing allow him to come to us immediately.  nothing.

 

u can ask for expedite.  but u have to have good reason.  u no say why ur husband in danger and what country.  maybe he move to another city in his country to be safe.  can he do that?

The above responses regarding expediting visas, invitational visas, etc., are correct.  Such processes do not exist.

 

You are unclear as to what kind of danger your spouse is facing in his home country.  If he is in legitimate, serious danger, I would recommend taking the following options:

 

1.  Contact the United Nations Refugee Agency regarding the possibility of gaining refugee status (http://www.unhcr.org/cgi-bin/texis/vtx/home).

 

2.  Contact the U.S. embassy in your spouse's home country.

 

3.  Contact an immigration lawyer regarding the possibility of gaining a tourist or other temporary visa for your spouse and then applying for asylum once arrived.  As others have mentioned, it is illegal to enter the U.S. on a tourist visa with the intention of immigrating.  It is imperative to speak to an immigration lawyer before pursuing this option to ensure that your spouse does not break any laws that would make him ineligible for immigration.  Also, if your spouse enters the country on a temporary visa and is denied his application for asylum, he would be required to return to his home country upon the expiration of his temporary visa.  Please, please, please speak honestly with a lawyer before entertaining this option.

 

If these options fail and your spouse remains in legitimate, serious danger, I would recommend contacting your congressperson.

do you have verifiable proof he is in danger? simply saying he is will not cut it since anyone can make that claim.

what is the range of influence that the people wish to do him harm? can he get safe by moving to another part of the city? a different city? a different state? a neighboring country? it would be good to know why he would be safe here and not anywhere else since you may need to be ready if the trouble follows him here.

where in the process are you? how long ago did you file? and did you file as a usc or lpr?
