Hello my dear friends, 

 

I've just filled the AOS petition (and my husband the I-30). And he wants already to add me on his health insurance of his company. But they are asking for my SSN, we explain that I am a foreigner, applying for residency, and they answer: 

"I actually just heard back from our insurance broker. She said we can enroll your wife, but note there will be a form (legal document) for her to fill out stating why she doesn’t have a SSN and she will be contacted by IRS and/or CMS for not providing a SSN. (health insurance plans are regulated by IRS)."

 

Well, I do have a SSN, I got it more than ten years ago and only used for a couple of months in the US (with a J1 visa), but I am not sure if its OK to use this number.. I went to the Social Security office already 3 times, called a couple and nobody has the answer for me.. 

 

Does anyone here has / had the same or similar experience and please can advice me?

First, as others noted, the SSN is for life.

Second, you do not need an SSN for health insurance. Most places will request this (and may require it if you have one, like you do) but if you prod enough then they can add somebody without an SSN.

Exactly, I think it is kind of odd that they are requiring one, since we already explained my situation. 

But I was more concern when they wrote us: "she will be contacted by IRS and/or CMS for not providing a SSN. (health insurance plans are regulated by IRS)".

I don't want to have any potential problems. So if I can just use the one I already have, will be great. :)

having filed taxes while having insurance, there is no form you submit to the irs claiming to have had insurance and the insurance company does not have my step child's ssn but I was able to claim them on taxes and said they were insured. so I don't think there is any sharing of info and the irs just assumes you are truthfully filling your taxes.

Go to the Social Security office and ask for a replacement card. You should also update your address with them while you are there. They will send you a new card in the mail. This is what my fiancé (now husband) did when he entered on his K-1 visa back in May. He had previously lived in the US and had a SS #.  We had no problems at all.

As everyone said, I dont see why it becomes problem. 

Plus adding your name to your husband's healthcare insurance is rock-solid proof that your marriage is bona-fide. 

I would suggest that before AOS, at least, just visit a doctor to make sure that you are actually enjoying the benefits based on your husband's health insurance and bring the receipt (that fully states how you got this insurance through, how much your husband's employer paid for your visits, and any other records)

 

During my AOS interviews, the IO was very happy to see we had numerous doctors visit under my employer's health insurance.

it is in no way solid proof of a relationship, a person who married someone ten years ago after spending a day with them and has not seen them sense could be added to insurance as a spouse. all it means is that person A added person B to a health plan and is paying a slightly higher fee. for financial relationship evidence you need to show shared risk. and that is not there with insurance since the very purpose of it is to mitigate risk.
