Incorrect, there is no set amount of time one needs to be living in the US.

You have to show that you have either maintained or show clear intent to reestablish domicile in the US.

 

Different Embassies/Consulates have different standards on this.

What do you mean by " intend to reestablish "? 

 

Does it mean that we can start the processing and everthing and then at the interview or in the application i mention the intention of reestablishing once we get there ?

Yes, your spouse will need to convince the consulate that she intends to move back. Things like voter registration, bank accounts, emails to real estate agents about finding a place, etc, just "Intention" usually isn't enough, they will usually want concrete steps towards reestablishing domicile. Then she will need to either enter the US before you, or at the same time as you, not after you.

If I'm not mistaken there was a couple in Saudi that hadn't lived in the US for about 7 years. They were approved at the consulate, but they had family to move in with when they got to the US.

OP's case is different. As I understand, his wife has never lived as an adult in the US so they will ask for stronger evidence like the one I mentioned and other people mentioned (get an address, bank account, voter registration, ID, etc.).

btw my wife is 19 years old shes not that old if that matters about being " adult "

 

but lets consider she is entering the US WITH ME not before me, how can she convince consulate that she intends to move back by " getting bank account, address , etc... ) when she doesn't have any in there ? Do you mean she could do all tha online ?  Also its obviously that she intends to move back by starting the process otherwise she wouldn't !

Get an apartment

Go to school

Get a job

Prove ahe has a life there ...

 

 

After that, and it's n o set of time, ahe needs to petition for u and sponsor if she makes 30k or find a USC to sponsor you.

 

Unless she moves back and sets up a LIFE in American you can't just apply and love there 

 

So let me ask u, at 19 how does she intend to do this?? Depending on where she lives how does she go to school or find a job and make 2k/month???

Your wife has to prove that she has or will establish domicile in the USA.   Because she's sponsoring you she'll also have to prove that she has the means to support you via an Affidavit of support.  Source of that proof may be via Co-sponsors but not necessarily always accepted by the consulate.  Clearly she won't be able to prove that she has domicile because she doesn't.  Thus it means either her living in the USA and establishing significant connections to the USA or involves proving intent.   Looking at this skeptically from the point of view of immigration authorities will perhaps help to explain why her applying for the process alone is insufficient proof..    From the immigration perspective she is sponsoring you to come to the USA.  While later you may get a job establish ties to the USA etc.  Initially you are there because of her.   She as a USC has the right to return to live in the USA anytime she wants.  But from the point of view of immigration the fact that she wants to sponsor you means that they want to know that she really intends to stay and not have the two of you move to the USA and then her move back to her 'home' in Pakistan  while you stay in the USA and work to provide for her in Pakistan.  The idea is that since she is sponsoring you to be in the USA she must prove that she is living in the USA or PROVE that she intends to.    Job offers, apartment leases, voter registration, drivers licenses etc. all show an intent to some degree or another to remain in the USA.  The more proof she has or can generate to show she intends to live  in the USA the bettter her chances.  Good Luck

She gets on a plane, goes to the US, and does all the things we proposed.

 

There is no magical answer in which you suddenly do everything from the comfort of your home.

 

If she has no family there, who is going to be the financial sponsor? Because she has to set up a domicile, but someone has to be the financial sponsor. This is what @JE57 and @caliliving are referring to.

She's a student in college here where I live . She never worked before. But once she finishes studies she will start looking for a job ( in the US when we move there ) .

She's got relatives there but not very close. We'll find a sponsor.

 

If not, I've heard that if you have enough amount of money in you bank account, you don't have to find a sponsor ( I might be wrong ).
